Full Version: re-affirmed twice and sent back again for review by the department of state

Please I want someone who have similar experience to make there contribution and to advice us on what to do..I appreciate those who have contributed to our last post especially when my husband was denied the CR1 visa on the basis of relationship meant for immigration purpose..On September 8,2009 the USCIS updated our case and stated that its been re-affirmed without contacting us or getting any notice or something and shipped to DOS for further visa processing..On September 14 the same petition was returned back to USCIS again asking for request to review our case again..I am worried and after been happy for 6 days checking online again and discovered that it is no longer approved.My question is what do we do now,attorneys said they cannot help,my senator could not get the reason why we were denied,they told him that what we saw on the website was a mistake.The embassy in Lagos is not helping us at all...I will really appreciate whoever that could give us a good advice on what to do.Thanks

If your petition has been sent back to the USCIS, I would continue bugging the consulate to find out if they did indeed give a denial before sending it back. If they did, you may as well reapply because that petition will be dead by the time it resurfaces. I'm sorry and I can sympathize with you.

Thanks for your contribution..The latest on my case is that my senator tried to find why my hubby was denied the CR1 visa and the mail we received is that he had little knowledge about me.This is not true as he was asked 14 questions which he answered perfectly.the questions
ranges from my work,family and where I schooled.Another reason the consular denied him was that he claimed I have been married before.I have never been married and he was asked this question 3 times and he said no.This is the truth I wonder where the CO got his information from.I read in the letter that my hubby could not provide any verifiable evidence to our ongoing relationship..This is also far from the truth cuz the CO did not gave him any chance to see all the documents I sent to him.He only asked to see our wedding pictures and emails only.There were many docs in the suit case that Benny took to the embassy and he was not given the chance to see any of this...I called the US consulate in Lagos and I was told that that was insignificant to why he was denied cuz I have been married before and he did not know..I told her that they are making mistake on this and that I sent an email to this effect and to authenticate our marriage to the Consular who interviewed him ..am still awaiting response from the CO in charge...Now I am confused about this,the petition was re-affirmed and they claimed its a mistake on their website and now the consulate responded by a false information about our union and someone saying something else again..I hope someone could really advice us on what to do.I have been trying to contact everyone and I could feel that we are just been treated unfairly in this whole process...I will appreciate any one with very good advice or who has similar experience..thanks
