Full Version: Tourist Visa while waiting for K-3

My father recently had open heart by-pass surgery and has been back to the hospital two more times. Now it appears I may have to take over his care if he survives as he cannot make decisions himself. I desperately need my wife to come and visit from the Philipines to help me in this difficult time.

Are B2 tourist visas given to those who are waiting for a K-3 visa when there is a family ilness or death of their father In-law? My wife is from the Philipines and has been turned down for a B2 tourist visa 2 times in hte past. I have already received the NOA1 for the I-129F and the I-130.

thanks for any information or your own experience in this area

Visas for Medical or Emergency Situations (B-1/B-2)

Below are some of the medical or emergency situations for which we receive visa requests. Please read these to see if there is a situation that may apply to your case.


Visiting an ailing family member in the United States;
Attending a funeral in the United States;
Donating an organ for transplant to a family member in the United States; or,
Seeking medical treatment in the United States.


Although we understand the nature of these cases, applicants must still meet the same standard as for a regular tourist visa – i.e. demonstrate strong ties that will bring them back to their home country.


HOW TO APPLY

To apply, please check the Nonimmigrant Visa Application Procedures page. In addition to the basic documentary requirements, as specified on the application procedures Step 2 , the applicant must submit the following additional documentary requirements plus the additional documentary requirements mentioned at the Business/Tourist Visas page:

FOR THOSE VISITING AN AILING FAMILY MEMBER

Applicants must present an up-to-date statement from a U.S. physician indicating the condition of the patient, including contact information so that, if necessary, the consul may contact the physician.

Although we understand the nature of these cases, applicants must still meet the same standard as for a regular tourist visa – i.e. demonstrate strong ties that will bring them back to their home country.

Does this mean that if the person applying for a vis for a medical emergency cannot demonstrate strong ties to their home country, that they will be denied a visa? My wife has no assets and no job in the Philippines

Any experience in this from anyone?

Why don't you try to expediate the K-3 ? Never hurts to try all your options !!!!!!!!!!!!

Sounds like a good reason for your wife to stay in the USA.

She's got a history of having inadequate reasons to return to the Philippines, if this is the only change in her circumstances it's a change in the wrong direction.

How do you expedite a K-3? My wife just had our baby and this might help us.

you can't expediate because of a birth. but maybe due to health reasons of a family and if the father in law is deemed palliative.

Hi,
why doesnt she try to call her embassy? I did that as well and they expedited our process. I dont know if that will work for you guys, but if she wants to come to you to help you, she should get involved herself. Usually there are ways to explain your situation and such and sometimes it works out. Give it a try.

The reaon she was denied before:

she was not married to a US citizen, she was a single filipina, they never give visas to them.

The close ties she now has to the Philippines is that if she doesnt return there at the end of the tourist visa for the interview for the K-3, we will be dissqualified from getting a K-3 forever.

We would not jeapardize our K-3 for anything, the interviewer knows this and how much money and time we have invested already. we have extremely good reasons for my wife to return to the Phil.

If she stayed in the Us, she will be forever and illeagal alien and not be able to work, start a business, and will worry for the rest of her life. No those of us who are waiting for our K-3 visas have much to lose if our wife or husband does not return...
