Hello Everyone - Let me give you a quick senario before I ask my questions. USCIS has already approved our I-130 and I -129F for the K-3 visa. I want to change that to CR-1 visa tho. We have the NVC numbers for both as well. I haven't rec'd the email requesting "Choice of Agent" for the I-130. The I-129F has already been sent to embassy.

So my questions are 1. Does my husband have to call the embassy to see what our next step is or will they contact him?
2. How can we change to CR-1 from the K-3 visa process?

1. No your husband does not contact the embassy, they will mail him a letter letting him know when to come and pick up the packet for the K-3.

2. Do not act on any future requests regarding the K-3 and continue processing all requests for the I-130. The I-130 will override the K-3 once it reaches the embassy anyway, so no need to do anything else with the K-3. We had the exact same scenario and that is what we've done. At this point we are still waiting for an interview to be scheduled. We were approved on May 13th. The I-130 slows up at this stage because the NVC schedules the appts. at the embassy (but only allowed to schedule so many per month).

So this raises a problem. On the forms we put my husbands physical address. He is unable to receive mail at the address so he has a po box. We didn't give the po box address anywhere on his paperwork. Should he call the embassy and give them his po box???


I was thinking that we should continue the K-3 with the medical and setting the interview appt a couple months in advance giving NVC plenty of time to approve our case. By the time it reaches the Embassy, just have the I-130 override the K-3 and have the interview already set. Of course timing is key in the situation. What are you thoughts on that??? Has anyone ever done that???

Did you ever find out what to do about your husband's physical address? I've been trying to find the answer to my question like this for a while. My fiancee's physical address in Ghana doesn't receive mail either, so I was thinking to use her po box. Although the I-129f asks for the foreign fiancee's address two times, it doesn't say if we can use a po box. I don't want to put a po box address on there because they might want the physical address to verify where she lives, and if I put the physical address then she will not receive the mail.

So, how did you end up handling this?

My fiance and I are processing a I-129. NVC stated that our packet went to the Ghana Embassy on Sept 4th. Around Sept 17th, we hadn't heard anything, so I sent an email to the Ghana Consulate asking what the next step was to get his packet. On Oct 5th, I received a letter from the embassy stating my fiance needed to take the letter to the embassy on a Wed at 730 in the morning and return at 2pm to get his packet (remind you I live in the USA...why wasn't it sent to him??? who knows). So I emailed him the letter and he took the letter to the embassy on Oct 7th. When he returned for his packet at 2pm they gave him his packet and interview date of Dec 14th. smile.gif

I did finally hear from the embassy regarding my email that I sent to them almost a month later, letting me know that my fiance has picked up his packet and had an interview date...had to smile...cause I already knew. Hopefully my experience will help you.

One question...if anyone knows...so we have packet 3. Does he need to send that in before the interview date? and what is packet 4? Does he need this before the interview?
