Full Version: Dealing with customs under a 3 month Waiver??

Hi guys i was hoping for some advice to gain a smooth entry to the U.S upon arrival at customs


i will travel to the U.S with my girlfriend and son (both USC) in Augest for 3 months on the VWP.

My concerns are how to explain i am visiting? is it a good thing to say i am visiting to visit my son and or girlfriend for such a long period of time?

I need proof that i intend to come back to the U.K after 3 months ( which i do) but i dont really have any strong ties. i have just finshed working in Japan and therefor my fixed address is still my parents address i am employed by an agencey but i wont start working for them for another 3 weeks. i can get a letter from them explaining i am expected to return to work but is that enough to convince customs i will be coming back?

The purpose of my visit is to babysit my son whilst my girlfriend works at her new job. we will eventually file for a K1 Visa and i will return to the U.K then eventually return to the U.S on a K1.

Any advice to get through customs hassle free would be greatly appreciated!!!

I take it that she does not have ILR status in the UK?

Best bet is to Be Lucky.

Do not mention the babysitting, you are not allowed to do that on the VWP.

Go for a 2 week ticket and re-book if you get in.

Should i mention son or girlfriend at all or should i just state that im visiting a friend?

Am i aloud to re-book for a flight two and a half months later? or will that arrouse suspicion?

i dont want to jeopordise my chances of re-entry on a K1 next year

First of all, it's immigration that you're concerned with. Customs are the people who deal with your stuff. Immigration and passport control are the people who deal with you.

No, that's not the best idea-particularly the "son" bit. A girlfriend and a son in the US will be looked on as compelling reasons to attempt to cheat at immigration and overstay your 90 day welcome. Easiest way around it is to say you're visiting friends on a last break before starting your new job-there is absolutely nothing untrue in that statement; it volunteers enough information without raising any red flags.

Firstly, your return ticket and itinerary are almost always looked at, so having those ready and at hand is a plus. A letter from your new job or your contract with an expected starting date would be stellar. Bank accounts, bills, anything that can prove you live in the UK and intend to stay there will be of help. The idea is to prove you're returning to the UK and at the same time *not* alert them to the fact that you do, in fact, have compelling reasons to want to be in the US permanently.

Should have said that you need to make sure that the Airline will allow whatever ticket you buy to be rebooked, most US airlines do. Usually at a fee.

BA do if you give them enough notice, I postponed a trip back to US, long story, from UK due to never ending delay for my K1 interview several times and they only charged me once.

Rule number one is never volunteer anything, just answer what you are asked. That goes for the whole process.

The answer to Do you know the time? is Yes.

Do you think they will ask for the address you will be living while in the USA? Or what is your relationship to this person? If so, you are forced to tell the truth. I recently read a post of someone getting denied because of the VWP. They were excluded for 5 years, because the CBPO told him that he is no longer authorized to use the VWP after you submit an application for a K1 visa. Please find out before you travel. I would hate for you to damage the K1 visa process.

OOPS...I found the previous post and it was her husband not her fiance that was excluded from the USA.

In feb my Husband tried to enter the country for a visit. At the time we did not know that he was not supposed to come visit on his VWP. He was then cuffed spent the night in an airport jail and sent back to London. We have had our civil marriage a year before this, and he was coming for the Catholic prepartions to have the Catholic wedding. He was planing on going in and out of the country to comply with the visa waiver. Well we learned the hard way. We had not idea that was not possible. He was imediately deported, removed, or exluded at the airport here in Houston. Does any one know what this is called? Im sure its one of thoes three. Now we are forced to file for him just so that he can come in to have ur religious wedding. My question is. Since we have to file a waiver does any one know when and where these get apprved if your interview is in London. We were told that he has to take the waiver with him when he goes to his interview but...... if he does get approved for a visa do they process the waiver the same day? How long does it normaly take? Does any know the procees?

We even used the NOA1 and 2 as evidence he would be returning to finish out the process in London. The visa process does not make one ineligible for using the VWP.

i think my best bet is to travel in on a 2 week ticket and then change it after a week or so to stay for 3 months. whilst in the U.S can my Girlfriend then apply for the K-1 ??i i can then go home after 3 months and spend the time at home doing my interview ect....???

Yes. Believe me, it's easier to fill out the forms if the two of you are in the same place at the same time! Just make sure you have ALL of your documentation with you that you will need to file when you come to the US; a quick read through the guides on what you will need to submit for the initial petition will let you know what it is you need to be gathering.

I also entered whilst my K1 was in process.

My guess is that the POE considered he had Immigrant intent, there may be other issues of course.

And usually you are allowed to withdraw your application to enter, if he was deported he was either very very unlucky or there were significant other issues.

One potential area of concern that you should be aware of before you get a return ticket prior to when you actually plan to leave . . . the border guard will issue you an I-94. If he chooses, he may put the valid until date for the day of your return ticket instead of allowing a 3 month entry time. Of course, he may not as well, but it is something you should think about. It is the I-94 that determines how long you are actually allowed to remain in the country.

That applies to a B, I would need to double check but I am fairly sure the VWP is 90 days or nothing. I have yet to hear of a VWP being entered for anything other than 90 days.

There is of course bound to be one.

Even on a B it would be rare, and if you have that as an issue you have problems anyway.

I have never heard of anyones I-94 being dated for less than 90 days.....

I have traveled on 23 diffrent times to the USA over the last 25 years and my I-94 has never been for less than 90 days...

The VWP grants permission for a 90-day stay across the board.
