just learned today about the exsistence of imbra. I filed my I-129f back in the beginning of april. Everything has gone smoothly so far and the case has been sent to the american embassy. I wanted to make sure that IMBRA wasnt going to hinder my progress. I have heard of cases getting recalled, even right before the interview. I have no criminal record, but I was worried that my case could possibly get recalled due to lack of evidence or because maybe I filled out an old I-129f.

If you sent your petition after March 6th, and your receipt notice is after March 6th then yes technically you should be affected by IMBRA. I hope you don't get too much farther before it gets recalled. GOod luck,
Sarah

Everyone who filed after March 6 is affected by the new law because it became effective on March 6 - the International Marriage Brokers Act. It does not matter how you met or if you are male or female. You should be receiving a request for evidence - a short questionnaire - which you will fill out and return. Then your petition will continue processing. Check out the IMBRA forum for more information.

Also, you should probably give the consulate a call and ask when they've sent your petition back. They probably have done it already. Oh, and if possible, check your status online, by creating an account here (https://egov.immigration.gov/cris/jsps/selectusertype.jsp) - if you haven't done it yet. Maybe you'll get to see some update saying it's been sent back or reopened.

The thing with IMBRA is: you're supposed to get an RFE and answer a few questions that were missing in the forms you used (because it was not updated as per the contents of IMBRA).

I agree that there will be a delay in your visa processing. I would also suggest speaking with your Congressman to elicit his help in speeding things up. I went a step further by writing a letter to Tahirih Justice Center (which helped to write this confusing law) and asked them to assist in clearing up this visa mess.
