Just got a call from my congressman's office. They just received a response to their inquiry on my behalf. USCIS told them that the IMBRA RFE would not affect the processing time of our petition. When I got my NOA1 the processing time was stated as 80 to 110 days. I'm also a NSC transferree. So that means if they are correct I will get our NOA2 no later then 8/17/06. So we'll see. Of course now I need to get my RFE back in to them which should be in the next day or so. cool.gif

I'm a transferee from NSC too but my NOA1 was March 6th and I'm still waiting. I'm already at 129 days and got the same 80-110 day estimate in the beginning.

Well let's hope as soon as they get that RFE they will get your approval right out. That's what I'm thinking.

i hope that's right Dean. my NOA1 is March 17 so would be receiving approval any time now, biggrin.gif but not going to hold my breath. unsure.gif wishing speedy approvals to everyone.

Heap another shovel full on that pile!!!! IMBRA has already added over 2 months to the process in my case - just the time it took to return the file from Paris, probably back to NVC, then to NSC where it was originally approved, then transferred to CSC, then wait around for the RFE, now wait around some more for them to look at those piddly 3 questions, only one of which I responded "no" to. So for something that has no bearing on my case, it has been delayed over 2 months. My fiance would have been here by now, settling in, and we could get on with our lives. It is inconceivable that this could be construed not to be a delay.

I would have to thank Tahirih Justice Center for this, as they helped to write this confusing, overly vague law that has been almost impossible to implement. I just fired off another letter asking them to lend some help to unravel this visa fiasco that they helped to create in the first place.

I think, unfortunately, the congressman and senator information regarding processing time post IMBRA RFE return are only in reference to cases that were NOT recalled from the consulate abroad. My impression is this estimate of processing time only refers to cases that were sitting on hold at CSC while USCIS created the IMBRA RFE form. Since processing was complete for many of those cases, it make sense that they would not incur much more delay. (I am aware that common sense does not really come into play here).

People get upset, though, when statements are made which seem definitive, and yet, there are many cases out there to prove the statements already false....

I truly hope so.
However, there has not been an NOA2 issued to any K-3 filer for their I-129 since 2 months ago. This, in fact, is a delay.

I would agree with you there. People like you who filed soon after IMBRA went in to effect seem to be getting the shaft more than anyone else. Since your pettion was at the center for 3 months already before USCIS finally decided they needed to pull their head out of their butts. My gut feeling is that your petition and others who filed in March will start to get their NOA2's in the next few weeks. It just seems like maybe USCIS finally has a plan in place to move these backlogged petitions.

Well if the information your congressman received is correct, I should have my NOA2 by this coming Sat, July 22nd. We shall see if this holds to be true. I am guessing no, but I would like to be pleasantly surprised!!

I guess I should get my by July 25 then. LOL.... I would bet against it in a heartbeat. There have been no NOA2's post IMBRA yet from CSC, but they are starting to popout of VSC like mad. I guess they want to yank our chains a little more. There just sitting there taking bets on how many of us go insane first with this madness.

Damn I miscounted. 110 days would actually be August 20th for us. So we'll have our approval by then. biggrin.gif

Well I am at 121 days today and still no response from CSC in regards to NOA2's post March 6. I am still holding my breath, but when USCIS calls or writes an email they now need to ask for Blue Boy in the corner, because that will be me holding my breath!!! mad.gif
