I am trying to take a proactive approach and send my Vo everything she needs before she gets her packet.

Question:

1) When I send her the I-134 Affidavit of Support, will the past 2 years (2004 & 2005) 1099 along with bank statements be good enough?

2) Do they require the I-864 form instead of the I-134 Affidavit of Support in HCMC?

3) Not a question but just a statement...this stuff really scares me.

They aren't so interested in bank statements as they are a letter from your bank stating your deposits, starting balance, current balance, and average balance. You might not be able to aquire a statement with all of this info, but as much as you can will be required. You should also send your 1040s.

It says you are filing for K-1, so no, you file the I-134.

You should be scared, but not as scared as another member who I won't mention his name but he knows he he was and didn't need to be so scared.

It's a fear we've all experienced and some of us still do (that is me ). However, I think you'll find a ton of support here on the Vietnam pages of VisaJourney. Thank you folks for your help and kind words. I have read the guides and have lurked on the forums for quite some time now. I did find another question I have managed to come up with about the support form.

I can provide last years tax, and bank information from the bank itself, but I was reading on the HCMC website about the support which says, and I quote:

"Original Affidavit of Support Form I-134 and the specified financial documents. Form I-134 must be signed by the sponsor and notarized by a Notary Public no more than one year prior to the date of interview and include tax records for the past year and an official letter of employment (on company letterhead) signed within the past year or a valid business license."

Now I have been a computer programming consultant for about 8 years now. Never had a business license or anything. To put it frankly, am I screwed?

For the last few years my income has been via misc-1099.
I'm having an immigration company do all the work for me, and they said it isn't a problem.
I'm guessing the tax returns are all you really need to prove income, because if you lie there... you have bigger problems, and bank statements to prove you're not rent/mortgage poor.

I know I am no help but being scared is just part of the process. I think that everyone who has to suffer through this is scared...not just about "will we get the visa" but...OMG we're getting married. All people getting married get a bit scared at some point...the visa aspect just adds a fun twist

um, how about your income tax returns? You've sort of pointedly not mentioned them.

Well, I will assume you meant me in that statement.

Hey look, I was terrified after everything I read here. My case was destined to fail from all I had been told, but I lucked out in two regards...

1. My letter from the IRS (including the envelope it was sent to me in) stating that they cannot yet provide me last year's statement. The letter provided the date they could provide the statement and that date was after the interview. Because of this they did not ask about 2005 income, which was ZERO for me and as a result I didn't need co-sponsors (I should add that I included statements going back to 2002 which showed high income earnings).

2. Just as important, the CO was great, friendly and when he found out that my fiance worked at an art gallery he recently purchased a painting from he became very friendly and started a conversation on art. He told my fiance her English was fluent and that she was very well traveled. The more they talked to more confident Anh became with her English. She was not nervous at all after maybe two minutes of the jitters.

That CO was a gift from God. That's how Anh and I look at it.

Well, we're all very happy for you Matt, and you know I love you. I have to admit I had very serious doubts that you would have the ending that you guys did have, but in the beginning remember I DID tell you your case had a lot of positive's about it that could leave little doubt in the eyes of any consular that your relationship is genuine.

MISC-1099 is no problem.

I submitted transcripts for TY02-04, and a copy of the extention for for TY05, with MISC-1099 as my only form as income, and she was approved.
