Hi -- I got an email notification 10 days ago stating that a RFE is on its way. I was expecting the IMBRA form (being discussed on the forums). However, I got a letter requesting a copy of my passport picture page and my birth certificate (3003 -- Please submit proof that petitioner is a US citizen). Did anyone get this also? Was I supposed to submit proof along with the I-129F?

I wonder it I'll get the IMBRA related RFE after this RFE has been processed <sigh>.

Yes.. you were. All of the supporting documentation you were supposed to submit was in the instruction part of the form. Check it to be sure you didn't overlook something else.

And yes, you should still expect in IMBRA RFE.

Did you send the proof your US citizenship with I-129F? If not, that is what they are asking for. I assume, after they receive the proof of citizenship, they will send you IMBRA RFE.

Thanks -- and yes, it is time to fire the attorney. He was paid to make sure that all the evidence and paperwork was filled out correctly. I am so PO-ed at him.

I'll check everything myself now.

Your NOA1 receipt/received date is before March 6....Yes? That being the case you do not fall under IMBRA. You have received the usual RFE when a document is missing or they need further evidence etc. On return of this and it being satisfactory, an approval is generally not too far away unless you get held up with security checks.

Aussie is right. You should not be affected by IMBRA, since you filed before March 06. I did not check your timeline. By the way, your timeline says your I-130 is approved on May 5. Perhaps, you can think about focusing on I-130? How deep are you in the NVC process?

Thanks for all the advise guys. Yodrak, actually the atorney never asked me for any proof of citizenship and like a dumba**, I didn't bother checking the evidence list. Now the attorney is asking me to send a copy of the passport picture page.

As for the I-130, on 6/12/2006, the AOS and immigration visa fee bill was sent to the attorney (NVC automoted line) and my attorney is not responding to any inquiries from me (can you believe that).

So I need some advise from you all. This is what I am thinking of doing for the I-130:

1. Change my agent to by myself.
2. Change my spouse's agent to be me.
3. Generate the AOS and send it in to NVC (following James's shortcuts)
4. Generate the IV bill and send in the payment

For the I-129F, send in the RFE directly.

Does this sound like a resonable course of action? Please help helpsmilie.gif
