Any K3's get IMBRA RFE yet?

No I have not recieved an RFE yet...are k3's supposed to get one? Sorry if that sounds like a dumb question but I was under the assumption that k3's don get one..there is just a delay in our paperwork due to all the k-1's that filed after March 6th.. Of course I am newbie and not as knowledgeable as others on here so I could be wrong...

well i am not sure if we(k3's) get one. I think we are on hold cause of the higher volume of (K1's). Well atleast thats my hope. I was just curious.

Yes I got it, I got it todayin my mail, I had no idea I was getting though ( no emails no notification on the USCIS website). I am gonna send it off first hting Monday morning. , I am happy and dancing now because I am kindda sure thatthey are moving.

I have received the RFE today (July 1, 06) by postal mail. I did not get any prior email notification. Anyway, the form basically says that the information must be provided within 87 days or the petition will be denied. There were three questions that NBC asks the petitioner to answer:

1. Did you meet your fiance(e) or spouse through the services of an international marriage broker?

0 Yes

0 No

If you answer yes, please provide the name of the international marriage broker and where the international marriage broker is located. (Attach additional sheets of paper, if necessary).

2. Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes...........and so on (same thing as they are in the new I-129F)

3. If you have provided information about a conviction for a crime listed above and you were being battered or subjected to extreme cruelty by your spouse, parent, or adult child at the time of your conviction, check all of the following that apply to you.

0 I was acting in self-defense.

0 I violated a protection order issued for my own protection.

0 I committed, was arrested for, was convicted of, or plead guilty to committing a crime that did not result in serious bodily injury, and there was a connection between the crime committed and my having been battered or subjected to extreme cruelty.


Then at the bottom of the form, it asks for signature, date, daytime phone number, email address (if any).

The letter asks that if the petitioner has ever been convicted of any of the following crimes (mentioned in
I-129F), then the petitioner has to submit certified copies of all court and police records showing the charges and dispositions for every such conviction).

Now, it is obvious that all K-3s are surely affected by IMBRA, as I expected before. Those USCIS customer service people who repeatedly said K-3s are not affected, surely are confirming the misinformation status. For my case, my I-130 is already approved and NVC process is well on course. So with this turn around with K-3, even if I get an approval by 2-3 weeks, I think, my K-3 will not be any useful anymore, as CR-1 process will be almost done by the time I get K-3 approval.

wohoo...looks like they are finally moving again. Hope mine comes through as well.

I had begun a tread in the IMBRA section under RFE for K3, so that it sould have a topic for itself , but this is fine. I have a quewstion though if you are using the date the RFE was recieved or teh date on the RFE it self?

I would say go by trhe date on the letter itself, the date it was generated by the USCIS. But that is just my opinion.

its not good to rely on mail dates. the date on the notice would be potray a more acurate picture

My RFE was dated on 06/28/06. I received it today (07/01/06) by mail.

Wow..This is so greatttttttttttttt! I hope I receive mine before i leave for India for a month otherwise I will be just stuck for another month ......:-(

You know, I have to laugh at this thread because I never thought so many people would be ever so happy to recieve a RFE!!! lol . I can't wait to get mine. I may be grasping at straws here when I say this, but if we are getting RFE's surely it must mean that they are moving along now?!...ANYONE???

Hafiz thank you for starting this thread..and thanks to those VJ members for letting us K3's no that you recieved an RFE...I surely hope it wont take 87 days to process those RFE's but I guess I will just have to exercise even more patience (am learning the true art of this since starting this visa process...lol!) and wait for mine to come and stay positive throughout all this and manage to find humor in this very long process that I have just began to embark on with my significant other!!!

well speaking of humor i guess now we get to fill that part of our timeline that ask if we got any rfe's ey? It would have been so empty without it lol.

well it is surely weird that all peeps currently are happy with RFE's . Normally it is a bad thing but hey now it becomes a very good thing . Cant wait to get it.

Add me to the party. I received and returned my IMBRA RFE today. There was no email or touch beforehand. Let's see how much time it will add to the process. I'm still hoping K3 is the fastest way to have him here.

Does anyone know if USCIS accepts the rerturned RFE via FedEx, or if we need to use Certified Mail?

It seems that they send RFE without any regard to the NOA1 (reciept) date. I see people who filed in May and June getting them. We filed in April and still nothing...

Got my RFE today, postmarked June 30. NOA1 dated April 3,2006. Just glad to see some movement.

looks like it .....but at least they are moving. Since K3 are in one service center I think they will maintain the order of NOA1. I am thinking that the volume of K3 will be far less than k1..Just guessing here not sure !

Huh? CR-1s are not getting the IMBRA RFE (as far as I know). Did you file for K3 and forget to update your timeline?

I used Certified so I can track online. FedEx may get there quicker (not sure they wouldn't accept it) but may not speed the process. Nothing moves July 4 anyway.

Well, we filed for K-3 and recently got some progress at NVC as well. Don't know which visa will be faster...
As for timelines, I had my timeline filled for K-3, and then I updated it for CR-1. In order to do that I had to change K-3 to CR-1 where it's asks what visa I filed for. And after that only CR-1 timeline is visible and updateable. Anyone knows how to fix that?

well you just go back to your timeline by using the link at the top. and then change your visa type to CR1.

The service center for your I-130 is Vermont. The NBC in Missouri is the center for all I-129Fs for spouse.

Thanks, aussiewench. You do more to help visa petitioners than people who're paid to do it! You could write a book. Because even people with higher educations are brought low when faced with this confusing process.

Now that K3s are getting RFEs, the next issue will be what to do: follow K3 or CR-1? It's a numbers game that's too early to predict. But if you got your CR-1 in 8 months, and IMBRA adds 2 months to a K3 that previously took 6 months, then ...

sent RFE back ..they should get it tomorrow ...lets see who gets the approval first !

We received our RFE on 07/03/2006, and sent it back via USPS overnight. So hopefully on the next proceesing time update, the date will have moved.

Jerseygirl I think you should write the book, your humor and positive attitude would help everyone going through this. No matter how down and discouraged I get some of your posts make me laugh and find my positive attitude again. we got the IMBRA RFE too!

Yes I received mine on 7/3/06. Returned today certified mail only.Not FEX I didn't think it was necessary, since they don't work quickly.

you saved 7 bucks, i put mine in a priority envelope then i though about it i was like wait 7 bucks or 15 bucks, hmm, so i chose the overnight express.

Which one is this? I usually send in the blue priority mail envelope, that costs $14.40 USD. Which envelope did you use?

i used that flat rate express mail envelope. Its blue its says express mail on it. its $14.40
