I had a previous fiancee petition filed last year. It was approved but things didnt work out. I requested a cancellation of the request. Long story. But anyways, I met my baby and we filed. It was recieved Mar 29th so IMBRA applies to us. The form seems to say that if you had a petition approved in the past two years I must request a waiver and include documentation of why we should get a waiver???

Anyone know anything about this? What are they looking for. I wrote a letter to send when I get my RFE (still waiting on that). There really isn't 'documentation' on why I should get a waiver except for the obvious. I would think the entire pachage I submited is reason for the waiver? I love her and she loves me. We want to spend our lives together. The 'EX' cheated, so there really isn't hard docs that could be submitted or anything.

Any ideas or thoughts on this matter?

sbgwolf,

You seem to have a good handle on things, as I understand this provision of IMBRA.

I have a similar question but mine has to do with two previous K-1 visas in the past sixteen years. I have to file a waiver and I can't find anyone who knows anything about this particular circumstance. If you find out, can you please let me know. I am rather panicked. helpsmilie.gif

Kitkat1 was describing an immigration lawyer that works with waivers.. I know the one they were asking about was due to overstaying their visa.. but perhaps they deal with all visa waivers.. I checked out the attorneys website and they do quite a bit.
