OK Just got off the phone with VSC. Didn't want the info to get lost in a longer post. (FYI: I had my petition recalled after getting my NOA2 and had no updates to my incorrect online status since April).

1) I was encouraged by the rep (as I was the last time I called) to SEND IN AN EXPEDITE REQUEST.

2) She said the recalled petitions are awaiting re-assignment to case officers, a process she seemed reasonably certain would happen by the end of next week.

3) She could NOT answer how long it will be from re-assignment to RFE, or what format if at all the RFEs would be in.

4) She asked me twice how I met my fiance, and the discussion that followed led me to believe that USCIS classes match.com and other internet services in roughly the same league as an IMB.

Therefore I will fax my expedite request ASAP, and if you are planning to do the same you may find this other thread helpful....

I met my Fiance at Mate1.com. They said to ask an Immigration Attorney if they are considered to be an IMB!!!!! They don't even know lol!

Iīm over the re-assigment thing for a week.
Itīs been 8 days since they reopened my case and I still havenīt got any touch after that.

I sent an expedite request last week Fedex when you first posted your suggestion, but nothing happened since then sad.gif I know they received it around Wednesday or Thursday, I tracked it at the time, I forget what day it was.

Well I think the rules state a max 72 hour response time on such a request. So here's hoping MadMan or I know something by then. good.gif

Aque I think you should call them and you can get a status report on your request, as you are outside the 72, and let us know. After I file I will too.

Bad news for NOA2 people. The officer told me the RFE'S for NOA2's wont be going out for 30 to 60 days. And they still do not have my Petition from the Embassy that was sent to them on June 2nd. This is bad. Also told me they can't expedite on there end. And do anything to expedite on the Embassy end either. Really screwed up

I know, I asked the officer about that... He said they are assigning out the cases and NOA 2 people have not been sent out yet. He also informed me ...kind of... that my Dating website is a IMB but would not confirm. He said the law was set up to be interpreted in a broad way, and they don't even know!
Good News, My Congressman Simmons here in Ct has someone from his office trying to find out what the deal is.
I also have contacted the office of Senator Lieberman. No answer from him yet though.

Did they tell you to wait for another 30-60 days or they said they wonīt be sending it?

They said the next step is they are going to be sending RFE'S out to NOA2 people. He said the delay is basically this has never happened before and there is no protocol for NOA2 people. He said expect the RFE to arrive between 30 and 60 days and there is nothing else anyone can do. He also warned me that the Embassy in Manila word has it is going to "Be looked at" because of Fraud. All I need now is AR Hell in Manila too after getting through all of this.

So thatīs not that bad.
Thatīs their standard answer for everything.
What takes longer is getting your petition matched with your alien file they keep there.
Iīm already in that stage.
Since Mew got her update and then her RFE being sent we can relax about the 60 days answer.

It wonīt take that long.

They are working on the recalled people and thatīs good news.

Mew is the member who had a recalled case and a RFE being sent out today.

I am not sure that you should take the words of this officer to the bank. I called yesterday, and the woman told me that I will receive the RFE in the mail within the next 2 weeks, and at the end she said several days. I also sent a request for expedited service thru the mail last week and haven't heard anything yet. What you have to realize is the fact when we sent in our original package, it wasn't opened immediately and worked on. So who knows when the 72 hours starts. I also asked the woman I spoke with about my request for expedite, and she told me that there was no way to tell me because that is a totally different department. It is so hard to trust anything they say, so don't give up hope yet.

So all dating sites are classified as marriage brokers? I don't understand this, because where I met my wonderful fiancee, yahoo personals, just doesn't supply someone with a dating service. It also supplies people with penpals and such. There are exceptions to the rule, and that is where I thought the normal dating sites fell under. If this is true then why is it ok to meet someone from the US on a dating site without this check? Aren't they in the same danger? We need to find out if these truly do classify as a broker. If so how do you find their location?

Hey, whatsup, just got back from my trip. I just read some of the new threads. I sent in an expedite request last Monday and I will call tommorow and ask about it. The 72 hours probably begins once the package is opened. I have called once before with no results. No status changes at all on my online case status. Good luck everyone.

How about us NOA1s that have also been put on hold throughout this IMBRA crap, that have already sent our RFEs back? Why canīt they get those out of their way and approve them already?!?!

I have no idea, I don't work for the USCIS and I hope everyone's case gets approved in an expeditious manner.

Oh, wow, I started catching up with the threads and 'panic' ;P is all around. Okay. Just to reassure you:

On June 27, I got an update saying the case was back in Vermont.
Later the same day I got an update saying that the case was reopened.
On June 29, I got an update saying a "notice requesting additional evidence or information" was mailed.


I too think they give the 60-day answer as default. Unless you're lucky to have someone over the phone nice enough to actually check your case in the computer, they'll give you the default answer. Also, I think that the fact that I got an update that clearly looks like an IMBRA RFE update is a sign that they won't take too long to start sending NOA2 people theirs. As soon as my fiance gets the RFE, I'll tell you what it is about.

When we got in touch with Vermont on June 19, they said they had no idea when they were going to send RFE's to us or to any of the petitioners with recalled cases, and yet, I got the RFE update. So... I truly think RFE's will start pouring really soon. We just have to be a little more patient (again, easier said than done).

Thatīs what my fiance keeps telling me. Weīll get approved, donīt worry. What I keep telling him is that Iīm not worried about if weīll get approved, I know it will come, I know this will be over eventually, but thatīs the problem, we know, but donīt know WHEN!

Oh, I know. It kill us that we can't rely on timelines and people's experiences when applying for a visa as we used to. But remember that even before IMBRA we could only make guesses - educated guesses, but still guesses.

You know what I do? I know it'll sound exactly like the opposite of I keep telling you guys - we're almost there, they'll soon work on our cases, we've come a long way, etc. - but I try to be as negative and pessimistic as possible. Weird, huh? I keep thinking it will take 6 months or even more so when I see people have had their cases reopened or have gotten updates, I'm extremely glad.

Even now, after the RFE updates, we can't be sure as to when they'll send our cases back to the respective consulates (and in the case of NOA1 people, when they'll get NOA2s) and the uncertainty really makes us extremely anxious. So I try go see each update and each piece of new information as something truly great. It works for me...
