Mike,
It's only the end of June, your fiancee will be wanting to apply for adjustment of status by the end of September. Delaying beyond that until early 2007 can be done but has its downsides.
Don't the self-employed submit quarterly tax statements, and payments, to the IRS? Show yourself making some money in the 2nd and 3rd quarters and include that with your I-864 in a timely application for adjustment.
Keep talking to that guy - if what he says makes sense to you and you feel comfortable using his suggestions then it may yet be useful to you.

I think when the time comes it will be close enough to 2006 tax return time. At least thats what I'm countig on. In anycase Change of status I understand will take other docs. beside tax returns. But the main thing is I can now go an fetch up my girl!

By the way someone the other day refered me to another forum and a certain person inparticular, and he was actually in the process of helping me prepare for a second interview with my legitimate return. He expalined that owning your own business and showing a loss doesn't nessasarily mean you don't make money. It all depends on where your losses come from. He had assured me with confidence that it wasn't a big deal. But alas it's all moot now! Thank God!

Mike,
Congratulations. A big load off your mind, I'm sure - you were facing some difficult issues!
Adjustment of status is going to bring it all back, however, and you won't be able to finesse the 2005 tax return then. Even though only the 1 most recent tax return is now required for the I-864 you may want to provide several years worth if it will make you look better.

Some of you might rememeber I posted here last week. My finacee was given a forn 221(g) during her interview. I had only submitted my 2004 tax return and told my fiance to let the interviewer know I filed for an extention for my 05 return there for did not have it yet. They turned her away with a form 221(g) with the words "wait to hear from us" Well we were freaking out! They gave no clear indication on what htye would do. Well I'm happy to report that the Embassy sent Rackel her visa in the mail as of yesterday. I called the Embassy and they told me after fully reviewing my AOS they made the descision to grant the visa! We are sooo happy words can explain. Just though everyone who was in on the topic would be surprised at the outcome.
