So this is different then the guidelines before?

I mean i dont claim anyone as dependent on my tax forms. So my househould size would be 2(me and my immigrant spouse). Or do i include my parents and siblings who happened to live in the house. Thanks

Did you file affidavit of support for your parents and siblings and if yes, are you still obliged to support them? Did you claim them in your tax returns? If yes, then you need to include them as well. If your answers are no, then your household size would be 2.

Q. It looks like my sponsor’s household income meets or exceeds the poverty guideline for his or her household size. How does the final rule change the instructions on calculating household size?

A. The final rule allows, but does not require, sponsors to include the income of any relative in the household who is not a dependent if 1) the sponsor includes the relative as part of the sponsor’s household size, and (2) the relative completes a Contract Between Sponsor and Household Member (Form I-864A).

You now have the flexibility to decide if you want to include these household members in your "Household Size"...

When and Why would you?

One benefit to those who need a Joint-Sponsor and this J-S is a household member, then you would include them in the Household Size and they would fill out the I-864A.. and their income can "pool" with yours (ie: they combine to meet the guideline).

A J-S who is not a Household member fills out the I-864 and their income cannot pool with the sponsors.
