Hello everyone!

This seems to be a helpful resource for many people looking for help regarding the K1 visa.

I don't want to make things too complicated, so I will keep it brief.

I am American. My fiance is French.

USCIS sent us our 797C Notice of Action dated February 2, 2006.
USCIS sent us our 797 Notice of Action dated April 18, 2006
The National Visa Processing Center approved and sent our file to the American Embassy in Paris on May 5, 2006.

Somewhere between May 5 and May 25, 2006 the American Embassy DID receive our file.

But, on May 25 2006 the National Visa Processing Center received our file from the Embassy... During which time (May 5 to May 25) I was worried the Embassy didn't receive my petition, so I faxed them. They informed me that they didn't receive my petition.... but they DID receive it!!

USCIS-Nebraska hasn't contact me at all about this situation. I feel helpless and don't understand what to do. I went to USCIS in Milwaukee and they too have no idea where my file is. NOBODY KNOWS.

What should I do?

HELP!!!

(I did contact my state representatives, but no word on any of their findings.)

my fiance is french as well. from your dates, you shouldn't be affected by IMBRA. he received a call from paris on may 11 cancelling his july 18th interview. it took us weeks to figure out why but it is due to IMBRA as we filed post march 6th. but you filed pre.....i wonder if paris screwed up and sent back all I-129f's when they got the recall notice from the US. if it helps, i did confirm it was sent from paris on may 25th back to NVC to be relogged into the system. it then went back to VSC june 5th.

i hope i can help more later, i have to run out the door.

There was another case of a mistake being done and they realized it and rescheduled the interview, I think.

after reading your post again i don't think you need to worry abaout paris. i would start hounding NVC. it sounds like it's still be there. i suggest call NVC and email them as well - nvcinquiry@state.gov

i would also call the state dept. they were the most helpful when i started trying to figure out what the #### was going on. even though you don't have the visa yet, they have access to all petioner cases. and they were able to tell me dates of when and where my case was and went. and kill them with kindness! i got a better response after i chilled out and became human again.

My finace is also in France. Our NOA1 receipt date is March 6, how unlucky is that, NOA2 march 31. Sent ot Paris Embassy by NVC apr 12. Fiance received
Instruction pkt Apr 24, returned checklist etc. May 5. Never heard a word from the embassy afterward.. tried in vain to contact them from his side of the planet and mine. finally received an email from CRIS that my I129F petition had been received by USCIS - no explanation why, assume due to IMBRA and the March 6 NOA1 receipt date. Got antoher email June 20 that case has been reopened on motion of USCIS and will recieve decision when processing completed. I assume the case is back at the NSC where it originated, I was not informed that it had been transferred to CSC as many other NSC K1 petitioners have said. Hopefully, if this is the result of IMBRA, the RFE will arrive shortly and we can get back on track.

Do you or any other people with fiancees in France know how to contact the french embassy - NOT the call center (that is not even located in Paris I learned after shelling out 15 euros to talk to an operator who told me the only option as to appear in person in Paris on Friday afternoons and hope you get into to talk to someone). This is not real convenient as my fiance is in marseille.

When you call the embassy. Be sure to say that you are an American calling from the US to speak to someone in the Immigration Visa Department. This was the only way I was able to talk to a live person without being charged 15 Euros. 33 1 43 12 22 22

This is how I found out that my case had been sent back to NVC. I spoke to them on 4/21/06.

Thanks for the tip! Very frustrating. BTW, I have some GOOD NEWS. Rc'vd emails yesterday and today that an RFE was mailed yesterday from the CSC, so I should receive it in a couple of days. I am going on the assumption this is the IMBRA related RFE which is why our petitions were sent back from Paris. Hopefully this is the case, and it is not some other protracted AR kind of thing. Hopefully you have gotten some kind of update from VSC by now. There seems to be a lot of confusion with the priority of how the recalled petitions are being processed compared to the K1 petitions that were on hold. Hang in there! Who ever thought this would be such a nightmare?

I havent heard anything yet. I am so stressed out about it. If IMBRA was started through the violence against woman act and marriage brokers, how does this even relate to me. My foreign fiance is the man and we met while I was on vacation in Paris almost 3 years ago. So frustrating. I can not plan my life because of this and it goes against my personality. sad.gif A toute a l heure.

I hear you. I have similar circumstances, I'm the woman, met my fiance in France while on vacation, went back and visited him, he has tried to get a French passport to come here on the visa waiver program, but if we think the American bureacracy is slow, the French operate on geologic time by comparison. They gave him a French ID card when he arrived years ago, and took away his Comoran passport, and now won't give him a French passport, making him a virtual prisoner. So in the meantime, his family back in Comoros helped get him a new Comoran passport, but he still needs a visa to come to the US. So here we wait. C'est tres complique, n'est-ce pas? And with him not being an Anglophone, and my French being limited, this whole mess with the case being returned to the USA has been doubly enerve. wacko.gif It's sure irritating they have not updated you at all since Paris sent yours back. I have seen several other people with recalled petitions who are in the VSC who are also anxious to get an update. Downright inhumane! mad.gif
