I overstayed a while back on a VWP, for almost a year, i deeply regret it now, i was in a bad mind set and scared to go back home alone with nothing and to nothing. My partner fully supported me financially during my stay. I left on the plane no questions asked and havent heard anything since. I know im likely banned from ever using the VWP again and i know im likely banned from returning to the US for at least three years. In the future we want to live in the states, my partners younger sister is mentally impaired and will need constant care once their parents are gone, i hate the thought that in a few years we may be split up because i wont beable to go back to the states due to my overstay (i KNOW this was wrong, i dont need nasty comments about it, i made a huge mistake and i dont expect sympathy). In the future would i need to apply for one of these waivers? Or could i enter with a work visa once i have my degree. Marraige is not an option. What other ways are there to legitimately be allowed back into the US after an overstay?

yes you are right, you are banned from entering the US for 3 yrs and you can never use the VWP ever again. But you should know, that you are not the only one that has ever overstayed in the US.

Do you have a bf/gf in the US? If you have, and you do not want to wait 3 yrs to be together you guys can petion for you as a fiancee and then file a waiver for the overstay.

But yes, you need to contact the embassy and you will need a visa before you are able to enter the US again after the 3 yrs are up.

You need to read the original post carefully. They said marriage is not an option. From this and the use of the term "partner" I assume they are a same-sex couple--there's no family based immigration based on that relationship.
