Full Version: Finally got interim EAD in Dallas, 2nd try

Well we had our second infopass today in Dallas, and this time I was the one taking my husband to the appointment, since I didnt have to work today. It was actually pretty empty, we had an 1100 appointment and we arrived at 1030, the officer at the front let us right in. I dont know how many read my post before, but we had made an appt before for the 91st day, my Dad had to take Carlos, and he was turned down for the EAD, the woman there said because we filed thru the MSC/NBC we had to wait for their decision, no matter how hard he insisted and he was given an email address to the lockbox. Well today we went and it was the same girl, she looked at all the documents and asked "why were you denied?" and I told her we have not been denied, we havent heard anything since the bio appt back in April. She then says well you filed through the National Center so I cannot issue EAD because we dont know if he is eligible for it. I then told her that this is for the interim and here is documentation from 3 places on the national website that says he is OK for an interim EAD to tide him over until we get the real one. She then interrupts and says well you did not file here and then I told her that I wanted to speak to a supervisor, because the rule is plainly stated and we are not asking for the decision on the petition, we are merely asking for the interim as stated. She then said for us to take a seat and she would go ask a supervisor. My husband thought we would get denied again because he figured the supervisor would always back the employee. Not 2 minutes later she returned and said Ok I will be sending and email to the MSC stating that we are giving you your EAD. I figure she found out she made a major blunder, because I know from being in a job that sometimes involves supervisory approval on issues, it would take much longer if it was a difficult decision. At that point we also asked about the AP document, which she said she could not issue, but would do an inquiry saying that we came and asked because it had been way too long. She seemed to be wanting to make up for her mistake in wanting to deny the petition. We were then sent to wait for his document to be processed. She called him back up and said we would get an EAD that expires Jan 1 2007, and that she had done the inquiry about the AP document. Carlos got his picture done, the EAD in hand and we were done by 1pm. This is a major load lfted off our backs now...that was the one thing that was causing the stress, I dont mind if the AOS is slow, now at least life can be a little bit more normal. We are hoping that this will help the AP doc along, seeing as he and I really love to travel. And to those of you who suggested we ask for a supervisor if we did not get a satisfactory decision..THANK YOU SO MUCH!!!

Congrats. Im glad to see that u took a stand as insisted on speaking to a supervisor. Im sure that really helped ur case, b/c the girl would have probably deny giving ur husband the interim EAD.
