heart.gif I got approved both visa application i-130 and i-129f. Do I able to go with CR1? Even if I did start with K-3 visa and NVC already send file to Delhi, India. If I want to continue with CR visa what steps are necessary I have to do? rose.gif

The approved I-130 is going to take approx. 2-3 months to get through NVC depending on if you use James Shortcuts or not, how fast or slow the exchange of these bills and forms are, and if there is any holdups with security checks. You do have time before you have to submit to the consulate post that you are ready for the K-3 interview, so you can hold things up at this stage. When the petition is completed at NVC and sent to consulate post it will over-ride the I-129F petition.

Hope this helps.

hey
thanks, I already got letter that say that NVC send my file (I-129f or K-3) electronic to the Delhi USA consulate with in week from 15 may. how can I hold k-3 visa or K-3 visa interview? I like to go with CR visa instead of K-3 visa. but I also like to have back up as K-3 visa in case if CR visa take long time or create some unknown type problem.

There is ways of slowing down the process once at the embassy. eg the time it takes to get medical, police certificates etc plus the form you will then submit to say you are ready for interview. To my knowledge you can hold off on sending this in for x amount of time. Im just not 100% on the timeframe. With the CR-1 I know it is a year. Hopefully someone will know exactly for the K-3. Have you looked also to see what the length of time is to be scheduled an interview?

Again, right now i am not sure when is going to be schedule an interview. i am trying to put hold on K-3 Visa process, so i can bring her here with CR visa instead of K-3 visa. but i dont want to Withdraw K-3 visa before she get an interview through CR visa.

You can hold up the K3 for as long as a year, (by just not returning the checklist) but as soon as the consulate has received the CR package from NVC, the K3 becomes null and void.
