I have a pending I-485 and already have my advance parole approved 3 months ago, I also have travel plans back to my country with my husband for 2 weeks and made these plans more than 1 month ago. This weekend I got notice saying my I-485 has been sent to the california service center and from what I see here that could mean Im approved for the green card without interview and seems most people are approved this way within 2 to 4 weeks. Im traveling in 3 weeks from now.

My question is what will happen if Im approved for the green card while Im out of the country? will my AP still be OK? I will take my notice with me saying my papers were sent to california.

Or what happens if I get an approval notice just prior to my trip, say 3 days before but I dont have the physical green card yet? I heard there is a stamp for your passport but not all offices will give one my office is new york city. can i still use the the AP to travel, i dont want to losse my plane tickets and other parts of the trip are paid for.

losaida,

One way or the other, whether it be because of the AP document or because your application for adjustment has been granted and the CBP agent realizes it, you should be able to get back into the USA. Unless there is some other factor that comes into play and disqualifies you.

My guess is that if your green card gets approved when you're out of the country then you're fine since there's nothing you can do. But if its approved before you leave and you receive notice of it then you'll need to check with USCIS whether the AP is still valid or whether you can substitute the approval notice for a green card(until it arrives)

I found the below excerpt from the USCIS site.

"Aliens in the United States should, prior to departure, obtain Advance Parole in order to re-enter the United States after travel abroad if they have:

Filed an application for adjustment of status but have not received a decision from the USCIS"
