I dont say much but I read a lot of your posts. I have a very important question to ask and I hope someone on this board may help me or point me in the right direction. If my SO passes her interview she will get a K1 visa in her passport, and my understanding is with that visa once you come to america you cannot come back to JA unless you file for your travel documents. Well my SO has a crew visa and wants to keep working as a flight attendant for a month after the interview. I am afraid that when she returns after her first flight to the US after the interview she will be denied when she comes up for good on the K1 visa. When she come to US on a flight the immigration officer scans her crew visa, would that entry qualify as a different entry than the K1 visa? or do you think once you are up it doesnt matter what visa you used, you cant go back till you filed the AOS.

Wow, Jski - Sorry to say, I have no idea! I would try contacting the Dept of state - I know the K1 is a one entry visa, so I wouldn't risk entering the US without a clear cut answer or confirmation. Her employer might know something about it also -

What about asking the CO at the time of the interview for the K1 regarding the particular situation your fiancee faces. They could possibly hold-off on actually stamping the visa in her passport until she is ready to emigrate(i.e. come on the K-1 visa) to the US, even though she gets approved previously.
Aren't flight crew members ushered through a different line at immigration when they arrive to the US? If upon arrival she is in uniform, it is clear that she is working for the airline and using her crewman's visa. If after the K-1 interview approval, the crewman's visa does not become invalid (a question that needs to be asked at the interview) then there should be a way to use it in the interim without triggering the K-1 visa's one entry limitation.
Definitely worth finding out from the Consulate or the dept of state.

I agree. If she goes through immigration on her return to the US, that will be a problem.

When she goes to the interview they will take it from her and cancel it. My husband was working on a cruise ship and they cancelled it right in front of us. That is right at the beginning of the interview. That was in October 06.

I agree with Darlene. I could not remember since it was a while ago when my cousin moved to the states. It was canceled at her interview. I left her a message, since I'm not 100% sure. She also worked for AJ.

So, if cancelled, she then loses her job? Is that what you are saying?

Yes because it is understood you are going to the states on a finace visa and with that you cannot work. They cancelled it before we were approved. He would have been out of luck if we were not approved.

Thanks for all the reponses. I hope that is not the case of them canceling her crew visa. The reason why we want her to still work is for her retirement benefits, she need to make it to the middle of Nov. for it to be ten years. I will also do what sus says and call the state dept.

It seems like the general consensus is that the crew visa has to be cancelled in order to validate the K1 visa. I do know that she will have problems with immigration if she is entering the US with the K1 in her passport. It is a one time entry visa so she will not be allowed to leave and come back in once the K1 has been activated by her entering the US (for whatever reason).

Do you have an interview date already scheduled? If so maybe you should look into postponing and rescheduling the interview so that she can work and receive her retirement benefits.

I agree with Yardie Jski. Call the 202# and see what they say to do, but otherwise e-mail the embassy asking for a rescheduled date. Not really what you want to do after waiting and waiting, but they should que you back in for November.

Is it possible that she work a different route, one that does not enter the US?

Actually Yardie even though I hate the idea that might be our only choice. I am also going to see if her job can work with her and see if she can retire early because you are right the consensus shows the crew visa will be invalid, but like Darlene said the dilemma is how can you retire if you dont know if you got your K1 visa approved yet!!!

Just a quick question. Is it possible for her to do another job for AJ until November? I know it's not much time to start looking into another job function. I would hate to lose my benefits after being there for 10 years.

Both you and Islandwomen have come up with good ideas. I will discuss them with her, but the fact remains like someone said she will give up her post before getting approved.

What I mean is in the beginning of the interview which was stated by a couple of people in this thread the crew visa will be canceled before we actually get an approval, so say for instance we get denied for a K1 visa she could not go back to work right away because her crew visa has already been terminated. I think Jomo was asking if this is true too, I really need to vaidate this.

I wonder if there is a way to not let that happen. Meaning, since you have the heads up on that, don't let them cancel it until after you have been approved. Just thinking out loud....

Is anyone in HR able to help her out? I can't imagine she is the first one to have to go through this. Sure does make it hard on her.

Hopefully she will be able to make a transfer within AJ from JA being home base to FL being home base. Remember if she enters POE at JFK she can get a temp work permit. If all that worked out she would only have to take a temp leave of absence....

If they cancel her crew visa b4 approval and deny her K1 is crazy..they r putting this woman out of work or at least as a flight attendant..if she is working or has to travel for work..how come this will be a problem if she enters the US as she normally do? Can they just stamp her crew visa and disregard the K1? it would not be in her best interest to not go back to JA since she was already approved for the K1..immigration i tell..i wanna know the method to the madness

I spoke to State dept. they said they cannot see an issue as long as she tells the immigration officer to make sure and use the crew visa. So I called the Immigration dept. and they said it cannot be done, as long as she comes up it triggers the K-1 one entry Visa. Two different answers..LOL So we are not taking any chances, we will either ask for a new interview date or try and use up all her vacation and sick days till Nov. I guess when the interview comes I will ask them if there is a way to hold off cancelling her crew visa till we know we got the K1.

I cousin left me a message yesterday. Her crew visa was cancelled at the interview after she was approved. She came to the states on a K-1. I just hate it when you get two different answers to the same question.

I have read some of the embassy reviews recently, and they VJ members stated that once their SO was granted the K1 or CR1 visas, any other visas they have were voided. So, she may not be able to use her crew visa after the interview anyway. Best of luck to both of you.
