it took forever for the file to get from NVC to HCM, now we have to start all over again. They had 60 days to implement the new law, yet, they didn't even start the recall process at this point, which is over 4 months after the law was signed. even HCM snailmail services are more efficient.

Your petition should be fine. They are only recalling those with a Receipt date for their NOA1 of March 6th and after. I noticed you got your NOA2 in February. I don't understand why it took so long for your case to get to HCMC.

mike, the date on my signature was wrong, i just correct it. Regarding the IMBRA, are you sure that NOA1 rather than NOA2 is used for the recall?

Actually, it is neither the NOA1 or NOA2 date. The new law affects people based on the date the petition was received at the service center. Anything from Mar 06 forward goes under IMBA. Your NOA1 will show the receipt date on it. This is what you go by.

03/15/06 - Received Case Number by mail
03/16/06 - Case sent by DHL to Vietnam
03/20/06 - Case is at HCMC Consulate
04/04/06 - Packet 3 sent
04/14/06 - Packet 3 received by my fiancee
04/17/06 - Packet 3 filled out and sent to Consulate
05/24/06 - Pkt 4 received, interview set for June 27

Matt,

You just need to look at the "Receipt Date" listed on your NOA1 or NOA2.

NOA1 is Feb 22 so I guess I am OK. Thank God. I'd go *** damned Postal were it after March 5.
