I am now married and in the U.S., currently filling out AOS etc etc. I am planning to apply for the Advance Parole because I wish to make (relatively frequent) trips back to the UK to see friends and family etc.

However on the form it seems to suggest that it can only be used for "personal emergencies and bonafide business trips", or something to that effect. Another part of the form also gives me the impression the AP is used for entry INTO the United States. It's got me a little confused!!!

I do plan to use it frequently and for whatever purpose I see fit, not just for emergencies or other things.

You don't have to give a specific reason for your travel. The AP allows re-entry into the U.S. during your wait for your permanent residence. You can leave any time you want! It's getting back in that's the problem - that's why you need AP.

HI! Or if i were you i would wait 6 month till you get your Conditional Card .
Also i didn't know that the British Citizens need to obtain visa fo to enter the U.S,or and Advance Parol fro to come back : unsure.gif
Don;t you just suppose to have a British passport in your possesion and can travel to U.S. Whenever you would like to?

Anyone who has a pending AOS application must have an Advance Parole document to get back in the United States. If you do not, they will assume you have abandoned your application and you will not be able to come back in.

don't worry about it, I wrote that I needed to see my family, etc.
Once they give it to you for 1 year, you can go however many times you want and nobody will ask you the reason...

Maria British people are subject to the same immigration rules as people from anyother country of the world... having a British passport does not get you automatic entry to the USA...

On the form it says "On a separate sheet(s) of paper, please explain how you qualify for an advance parole document and what circumstances warrant issuance of advance parole."

Do I really need to use a separate piece of paper and justify that request just to say "To visit family and friends"?

Not at all. Just put something brief down like 'family visit'. You leave the US on AP to work, play, visit relatives, go on a cruise, whatever. You don't have to give them a 'chapter and verse' reason. Just remember to be back before the 12 month period of AP is up, or be back for your AOS interview or back because you want to, whichever comes first.

Ok I've written my separate piece of paper and just said I am applying for advance parole in order to visit family and friends whilst my AOS is pending.

That should do it I guess!

No, advance parole does not allow one entry (or "re-entry") into the US. It allows one parole into the US. There's a difference, although the difference is not significant for most people. But the difference does exist and it is real.

Being granted entry, or being admitted, means that a person is both physically and 'legally' (in the eyes of the law) in the USA.

Being granted parole means that a person is physically in the USA but legally back at the POE waiting to be granted entry. As such, they do not have all of the same rights and protections that US law grants to people who are legally (again, 'legally' as in in the eyes of the law) in the USA. (This is why the Coast Guard works so hard to catch 'boat people' from Cuba or elsewhere before they hit the beach, and why the terrorist detainees were housed at Guantanamo in Cuba.)

1) At present I'm here having used my K1 visa and applied for AOS. Once I've got my AP and taken a trip and returned to the U.S., does that mean in theory that when I do return, I will have less rights than I do right now?

2) The AP document is good for multiple trips though, isn't it.

1) No. It means that in fact you will have less rights than you do right now. Just 'keep your nose clean' and it won't make any difference.

2) It should be if you asked for a multiple-entry AP. Did you?

Until it expires. But don't miss your AOS interview. And don't do things such that the overall appearance of the situation is that you have not made the USA your place or primary residence.

You started this thread back in May 20th of this year. It's been over 5 months before you applied. May I ask why the wait?
