After filing the I-130 for my wifes K-3 Visa I received a letter from the NVC that says they cannot process my case until I pay a $70.00 fee for the Affidavit of Support. I'm pretty sure I've read that I should ignore any correspondence I get from the NVC after the NOA1 from them but I would like to know if I should ignore this one or not. Also the letter also included the DS-3032 Choise of Address and Agent form which I've read I ignore unless I'm doing a CR-1. Any help would be appreciated.
Thanks,
Larry Duda

I-130 is NOT for a K-3 visa but it is to determine eligibility to apply for the CR(IR)-1 visa...
The I-129F which is submitted subsequent to the I-130 will result in the ability to apply for the K-3.
What is the status of the I-129F petition?

Just did the timeline dates are approximate since I've been in Iraq since I filed. Don't know if I've gotten the NOA1 from the I-129f yet because I've been on emergency leave the last few weeks and have no way of checking my mail thats back in the sandbox.

Did you file a I-129F after you received the I-797 from USCIS?

Yes, I sent out the I-129f after receiving the NOA1 on the I-130.

then I am not sure I would ignore the I-130 that NVC is processing since you do not know the status of the I-129F

Ah great that means I get to get a money order in Iraq since it says no personal checks. Thanks for the advice though.

From your incomplete timeline, I get the impression you filed the I-129F after receiving the NOA2 (approval notice) for your I-130. In which case, the I-129F would be rejected. Do you know the I-130 approval date? (NOA2 date) If the I-130 is at NVC, it's been approved. In any event, the CR1 visa is far superior to the K3 and it looks like your I-130 is far ahead of the I-129F. I'd be pushing through for the CR1 if I were in your shoes.
Please clarify your timeline as to just what the notice in June said.

I can't remember what the notice I recieved said because it is still in Iraq. It was the first thing I received from them so I assume it was the NOA1 but it is definitely possible that I didn't receive anything prior to that due to them getting lost in the military mailing system. That can also make my timeline seem longer since I mailed the I-130 while in iraq it took longer for it to get to the center and also longer for me to receive their correspondence.

u received the AOS fee for ur I 130 form..if u want to pursue the CR1 then u should comply the fee $70 for now and the next bill will be $400...its not for the k3 though..good luck!

Ok so then I ignore the fee and just continue on with the K-3?

proceed at your own peril.... considering you have no current knowledge of the status of the K-3 petition.

There's not enough information to come to that conclusion. You need the NOA2 date for your I-130 and to know the current status of the I-129F. In all likelyhood, you'll want to forget the K3 and pursue the I-130 toward a CR1 visa instead. This is very common when there's such a long time between filing the I-130 and I-129F.

Guess I'll figure out what to do in a couple days when I get back to Iraq and can check my mail. From there I will be able to see if I have gotten any correspondence from them and figure out what to do.

Why do not you check you case status on line and see what date was you I-130 approved.
