Hey guys, i need some help.

Supposedly my ASC Appointment was on August 1st. But we missed it because my husband was sent to ER on July 31st at 10:00 in the morning. And he was transferred to the ICU about 3:00 in the morning. And was out of he hospital th next day. So I really didnt have time to call the USCIS in Portland Oregon to tell them what happened.

Now Im wondering what will happen with my application? Am I going to get denied?

And if my application is denied, are they going to send back my I-751 package? or should I refile a new one?

Please help....

You should have records of your hubby's hospital stay (even his hospital wrist band)...photo copy it. Take it with your orginal appointment letter, explain the situation and ask to have you biometerics done. Do this ASAP, tomorrow if you can. If you wait too long, it may become more complicated to deal with. An InfoPass appointment might be a good next step if, they will not see you as a walk-in.

From what I've read, Wednesday's are walk in days for those in situations like yourself. Go in on Wednesday, and take along any record for your reasons.

It probably won't hurt to try on Monday either. I believe the biometrics stuff is done by 3rd party contractors, so the date that you are given doesn't really matter, they're set up so that the ASCs are processing a certain number of people per day. They then send the results to USCIS. At least thats how I think they work.

Don't worry too much, you aren't the first person to experience something like this, there's always going to be situations like this.

Im afraid I cannot do it this week. My husband is still not in good condition. I might just let our petition denied and refile a new one. USCIS in Portland Oregon is like 4 hours drive from my place. Are they going to send back the I-751 package if my application is denied?

I don't think you should put this off. You hubby does not need to accompany you to the appointment. At very least you should call USCIS this week and notify them of the situation and ask their advice- they may give you the run around, but you must let them know ASAP about your situation. I think it will be much simpler to deal handle the situation if you go to biometrics center. Four hours is a very long drive. Is there anyone, who might be able to take you-friend co-worker, someone in your hubby's family? If you can't make it, make sure to call them and see what they advise.

I wish your hubby a speedy recovery. rose.gif

Do you mean the address of the location they gave you for the biometrics appointment or the actual USCIS office. Biometrics are not done at actual USCIS offices, they are done at Application Support Centers (ASC).

Either way, I think even if you go next week you should be fine. USCIS is fairly slow with applications, so a week's delay on your part shouldn't be too bad. Go as soon as you can. They won't act on your no show this quickly.

Give them a call as well, though I'm not sure they'll provide you with too much helpful information.

Good luck.

Not true. I have had biometrics done at my district office. It's not always at an ASC.

Look at your biometrics letter, and check to see if they include a provision for if you were unable to make the appointment. If not, reeses16 has some good ideas on how to proceed. You cannot afford to let this slide.

Oops, my bad, I just assumed they farmed it out. Anyhow, I don't think it matters much for the OP.

OP, act as soon as you can on it, but don't let that worry you too much, a number of people have been in your situation without too much hassle. I think you've got other things to worry about right now. I hope your husband gets well quick.

You can send back the original ASC appointment and request another appointment by sending all the records of your husband from the hospital as a proof as the reason why you didn't make it. You can also call them about it and they will give you a reference number, another option was once a week there was a walk-in at the ASC, other place the walk-in day was Saturday and some place was Wednesday, check the nearest ASC in your place, you can also go by yourself without your husband because they will only take your finger prints and photo, as well your signature.
