Full Version: OH NO WHATS HAPPENING???

Hello, I am in a little of a bind and have a few questions in which I hope someone will have an answer!

Ok, my hubby is a UK citizen, a few months ago we went to our AOS interview and all went well!!!
But unfortunely things are not well and I being the US citizen am thinking of divorce, now he has a great job.... hes working for the top 17th company in America, he has plenty of money and can defientely take care of himself.... now here are my questions!!!

1. Can he just move back to the UK and pick up where he left off? (if thats what he chooses to do)

2. Are there any IMMIGRATION papers to fill out for this? (I know we will need a lawyer)

3. Will I get into any kind of trouble if I leave? ( I did not sponsor him, my mother did)

I never thought this would happen, but sometimes things just happen! sad.gif helpsmilie.gif

1 - Yes he can just return to the UK

2 - You need to notify the USCIS local office

3 - No you won't, but you need to make sure he returns to the Uk to get your mum off the hook.

So sorry to hear things have not worked out for you both..... there is nothing stopping him from returning to the UK... does he have his greencard yet? if he does and you do divorce then he could file to remove the conditions on his own if he want to stay in the US... if he does not have his approval/greencard yet then he should make an infopass appointment and let USCIS know that you are going to divorce..

You will not get into any trouble if you leave...

Thanks so much you guys!!!! No he doesnt have his green card yet.... only his work authorization card!!!! That makes me feel a little better!!! blush.gif

What's the hold-up on his adjustment? In your opening post you wrote that the AOS interview has been completed and went well.

You may find that you are his sponsor, although from what you write about him he may not need to lean on you. You might want to consult with an immigration attorney to find out what implications, if any, divorce might have at this point in his immigration process.

I guess what I'm wanting to know is how can he still stay in the US when we divorce, without any problems? And if so how does he do that? THANKS!!!

You are posting confusing, possibly contradictory, information.

What do mean by "he went to his AOS and he was accepted"? Did you attend this event with him? If he had an adjustment interview, and was approved, then he is an LPR whether or not he's received his Green Card yet.

A Work Authorization Card is not a Green Card. (Although I remember a poster a while back who thought that it was and also thought that the fingerprinting session for the EAD had been his AOS interview!)

Without accurate knowledge of your husband's immigration status it's not possible to answer your question, and in any case you'll get better answers from an immigration attorney, who will also be able to get you to explain yourself more coherently.
