My honey has a step-son he has had soul responsibility of for the past 10+ years. I thought he could bring his son with him as a K2 applicant. Now it looks like he cant because he is not the biological father. I just don't know what to do at this point. His son is a very good and respectful boy of 17. He attends school and scores well in his studies. Now we have to make the decision to leave him behind and try to bring him at a later date. Is there any way around this? Has anyone ever brought a step-child in on a K-2 visa. Since I've already submitted the I-129f with his sons' name on the application could it be refused because of the boy? The step-son will not be alone should his father leave. He will stay with his mother and her new husband. Its just the new husband does not like the son and there is always conflict between them.

Why wouldn't he be able to bring his stepson? If an LPR can petition for a stepchild (and can according to the USCIS website), why would he be restricted from bringing his stepson as a K-2 if all other criteria is met (age, etc)?

Sorry about your situation. My understanding of the guides here is that your option of bringing him here as a family member would be through adoption. Is this possible? Yet, it may be quicker to wait till he is over 18 and then go the student visa route, if that is an option. I'm sure someone else has better information on this though.

I was under the impression that a LPN is no longer entitled to petition for anyone until 3 yrs after they become a USC if citizenship comes from being married to a USC.
