MY HUSBAND & I WERE IN A MIDDLE OF A DIVORCE WHEN WE WERE CALLED FOR AN INTERVIEW IN A LOCAL CHICAGO OFFICE TOGETHER WITH OUR LAWYER..THOUGH OUR MARRIAGE DIDNT WORK OUT HE DID CAME WITH ME IN THE INTERVIEW . THE IMMIGRATION OFFICER STARTED ASKING US BASIC QUESTIONS LIKE NAMES & CURRENT ADDRESS WHILE LOOKING AT OUR DRIVER L. IF WE BOTH LIVED IN THE SAME PLACE WHICH WEVE BEEN SEPARATED FOR AT LEAST 1 YR. WE DID MAKE THE OFFICER AWARE THAT THERE IS A PENDING DIVORCE CURRENTLY ,ALL QUESTIONS WAS FOCUSED TO MY HUSBAND ABOUT DATE OF OUR MARRIAGES,WHERE & WHEN ,SAME THING WITH OUR PICTURES . THE OFFICER ASK MY HUSBAND ALSO WHY HIS WITH ME IF THERES A DIVORCE PENDING? HE JUST ANSWERED HIM BACK THAT THOUGH THINGS DIDNT WORK OUT FOR US ,WE DO STILL CARE FOR EACH OTHER ,HE DID A REVIEW AGAIN IN OUR PAPERWORk & TOLD ME THAT APPLICATION IS APPROVED & HE HAS NO QUESTIONS TO ME ,HE JUST SAID GOODLUCK TO ME & FILE FOR MY CITIZENSHIP SOON ..( IM SO GRATEFUL THAT HIS THE ONE WHO INTERVIEWED US ,HE COULD HAVE GIVE US A HARD TIME BUT THE INTERVIEW WENT REALLY SMOOTH). Yet another example of how the USC petitioner's testimony as to the bonafide nature of the union carries a lot of weight. Congratulations!

This part is a little confusing. How can you file for citizenship soon? If you're divorced, you have to wait another 2 years.

I think 2 years falls within USCIS's definition of the word soon, as in "your petition will be approved soon..."

I don't agree entirely with that. They filed jointly and they were in divorce proceedings...they are not divorce, yet USCIS did not know they were in divorce proceedings they got call for an interview...as a random issue. Good that their adjudicator was comprehensive and that they explain they were in divorce proceedings and accepted the fact that those things happens.

If the USC petitioner's testimony should carry a lot of weight then there should be no need of further comingled life evidence and then there should be full interviews as I-485s cases.

Actually what should be done is that regardless of a divorce, the US citizen should appear at the interview (in the case of one) and a warrant should be issue in the case of his/her failure to appear or refusal. Ha! that would be cool since at the end is because of them there was an entire immigration procedure.

This is kinda how I feel. If the US petitioner shows up, regardless of how the marriage ended up, should count for a lot. The original purpose of the conditional residency law was to prevent the alien from tricking the USC for immigration benefits. If the USC is happy to show up and say everything was kosher, move on, otherwise increase the burden of proof.

Ok, so the giant gaping hole in my logic is that some USCs will start a scheme to take advantage of this, or if the marriage really turns sour, they could (figuratively) burn the alien, but USCIS could always use their current requirements for such exceptions.

For the system the burden is and so far will be always on the alien, not the sponsor even the alien is here because there is or was a sponsor. Normally they (in their short minded logic mentality) is that if things did not work regardless that you spend three years of your life here, having a comingled life, not even talk about the period that if you were a professional could not work until your EAD was given to you or be able to drive (since you know how to because you were not in a bike/foot in your home country) because some retard in a DMV says that you can't because they don't understand the paperwork given by USCIS, etc etc...apparently after all that, having kids, contribute to the economy and make a new living and after all your effort and sacrifices...you should back pack your stuff and like those three years never existed in your life and with all that your happy USC sponsor can just sit down and relax. I am not saying that plenty of people that abuse of the system and that is why we are where we are, the system is not good at "specifics"...so if one make a mistake we all will pay the price...a high one. Pity but true. I just will wait...I received today my biometrics appt and see...if I get call for an interview I will prepare myself with all the evidence that I have which are plenty I don't know if they are "plenty" for them...but if they are not convince there is nothing else I could do. My ex is getting ready to be deploy to Iraq in the next couple of weeks...and he is not talking to me at all and he very well has told me he give a big F about me in this matter...and funny, because of ME he got a better place to live and money in the bank so he can continue having such expenses like talking with strangers over the internet.

I'm confused, I thought you couldn't petition for removal of conditions jointly if you are going through divorce, that you have to wait until the divorce is finalized and have the decree to actually petition removal of conditions with the divorce waiver.

Am I wrong? I assumed that if you apply jointly it means that all is well and good. If you file for divorce, then it's obviously not.

I can only assume that you petitioned jointly, then after petitioning you filed for divorce.

Please clarify.

In that case, they applied jointly...while in divorce proceedings they were call for an interview...they were not divorce at that time, so she couldn't file as waiver due to not having the divorce decree. Even they explained that situation to the officer, the officer granted the 10 year green card.

In the case she would get divorced BEFORE the interview, same situation could happened and she most probably would have to send a new I-751 since they were not longer married. At her interview they STILL were legally married, so they were approved under the joint statement.

They could file jointly and later on get on divorce proceedings...that joint I-751 is still valid until they get divorce.

In her case worked out even better since they split amicable, in the case that is not amicable other scenarios might happened.
