Full Version: Denied interim EAD (day 91) in DALLAS!!

Yes folks,

That's what Carlos was told today. Set up infopass for the over 90 day EAD appt,
took the app, NOA1..all that and he was told by some lady that they only do
renewals and not the 90 day thing..that we needed to "contact chicago". I called
the MSC information line and the guy could not believe that Dallas did that..he
then transferred me to a supervisor who was quite mean and said that day 91
does not gurantee that he will recieve EAD..I told him well we have had no RFE
we did Biometrics..what more do they want..he said well I cannot give you any
more informaton...all I can tell you is they don't have to give it to you. I HAVE NEVER
heard such insanity in my whole life! So I said well what..it depends on the mood
of the person? He said "im not saying that" I think we will just make another
infopass and I'll be able to go with im in about 2 weeks when my new job training
is over.

I'm so frustrated!! Why us? I cannot understand what our hold up is..no EAD no AP

Your only option may be to contact your Congressman's office.

My understanding is that if your EAD has not been refused AND it has not been approved within the 90 days, the Attorney General's office requires that the BCIS office grant you an Interim EAD.

The problem with going back is that you may see the same person.

Believe me, that can work against you.

Try and have the law (a printed version) in hand if you decide to go back.

And remember, amongst all things, KEEP YOUR COOL.

Liam has been waiting for his EAD since December 27( over 130 days ago). We had an RFE and responded with a receipt by BCIS date of 31 January (over 105 days ago).

We haven't received anything at all in the mail or via the internet, with no change to our cases. The last touch was February 25.

Remember, keep your cool...you aren't in this alone. I know it's hard, and it will make you crazy, but BCIS is doing this sort of thing all over the country, and they don't care how angry we are about it.

That was what I was always under the impression of..It says it very explicity on the uscis.gov webpage under instructions for obtaining employment authorization. We have not recieved any RFE's so I dont know what the trouble could be..and I have seen countless people on this forum who have gotten interim EAD all over the place, including Dallas. The woman didnt even seem to know that Chicago is not a service center, it's only a processing paperwork place.

That sucks. I am sorry I don't have any advice except to contact your congressman, and to schedule another INFOPASS. Good luck

When you scheduled your appointment, was there the option "It's been over 90 days since I submitted my I-765 and I have not received my EAD"?

Seems so odd that they wouldn't give you an interim when they offer that as an option for reason for appointment...

Yes, that option was definitely given...I dont know what to think or do. Im thinking of making an appointment in Houston and going there instead....

When you go next time, ask to talk to supervisor. If unsatisfactory, ask to talk to the chief station officer (the head of the local office). If you are still not getting anywhere with them, then contact your congressman.

My interim EAD was also denied by the local office -- for a different reason though. They told me that my EAD was "approved" by the MSC, but since I had not have biometrics taken the card could not be mailed to me. They also refused to give me a biometrics appointment (chopf##ks). I was lucky that the ASC did both the next week, so I got the card soon.

Your situation seem to be different, but the local office are definitely screwing with you.

We are int he dora program and we recieved the 70 day letter stating that they are unable to finish our case in 90 days and they had scheduled an ead and Ap appointment in the same letter with a date and so forth .. The interview !!!!! which wasnt even an interview smile.gif but was merly a 2 -3 hr wait and then a pic and a fingerprint again which took 3 min in a line up with 3 other people .. Proccessed that second by the loverly officer there ... I then recieved the card in hand before I left.. But I do recall when i went for my first dora appointment at the other place they told me the same thing no Ead proccessing there unloiek what is stated online.. My EAD appointment was at a diffent location, Homeland and Security just down the road..
