Hello All,
I recently got a job offer with a high profile technology company and they gave me an offer but my start date came before my EAD arrived and the company told me that if I don't bring them the actual card within 3 days of my start day (by wednesday Jul 23rd) then they will have to rescind the offer. Does anybody know of ANYTHING that I can do? Our family is in real need of this job and the job market is low these days. Any help would be greatly appreciated.

Until your EAD arrives you are not work authorized. You need to hope it arrives in the next two days or just wait until you get it and start looking for another job. Did you ask them if they will hold this position until your card arrives? You did not post a time line so we don't know when you applied, but you should have the card within about 90 days of your application.

Maybe you should have waited until you got your EAD for sure sad.gif I hope everything works out and that you do get your EAD before the job offer expires rose.gif

There is no way around that EAD. The only thing you can do is talk to your employer and see if they can postpone your start date. I really wish that you had waited until you actually had it in your possession, before you started job hunting. But you can't change what has been done. It is a serious Federal offense if an employer hires you without the proper documentation.

Have you gotten email notice that your EAD has been approved? Or some snailmail to that effect? If so, at least print that out and present it. If not...you're not going to be able to start that job. Again, not having your timeline filled out, really prevents us from helping you further.

I have my receipt in hand and then I also already had my biometrics taken on July 16th and got my appointment sheet stamped by the processing center. Anything I can do with that?

sometimes it will take EAD approval a month after biometric..

You should inform your employer to hold the job for you til you get the card itself. Sometimes it takes a month or two after the biometrics. I got my EAD approved and in the mail in one and a half months since I applied for it before my AOS. Anyway, you should have at least waited for the approval. I hope your employer would extend the time given to you. I suggest you give them a visit, show your NOA's and explain your situation to at least reconsider you. This way you would show that you are really interested in working for them.

1. There's nothing you can do until it has been 90 days from your receipt date. Even then, USCIS will not do much since there is no guarantee as to when you should receive your EAD.
2. It is impossible to help you when you have no timeline and give no information other than when you need your EAD by.
3. You cannot start work without it, so you'll either have to hope they want you badly enough to hold the job until you have your EAD in hand OR you'll have to look for another job once you have your card.

Exactly. Unless you have some sort of written confirmation that the EAD is on its way, there is nothing you can do. The company will not risk it since the law is quite clear about proof of work authorization/employment eligibility (see form I-9).

New Update. Thank you for for everyone's help. I actually did post the timeline but it doesnt show on this for some reason but it is added to the statistics and stuff. My employer said that by law they have to rescind my offer on wednesday BUT that when I get my new EAD card or a 551 stamp then they can re-issue the offer. I think that they would prefer to see the I-551 stamp because at that point they would no longer be employing a foreign national and they don't have to apply for an export license on my behalf so does anyone know if there is any way to get the I-551 stamp on your passport after you get your EAD? How does that work? Is there any way to fast track it or what is the timeline like? I think employing me as a foreign national would cost the company a bit of money.

I-551 = green card. We were given this stamp at our successful green card interview but it seems many offices are not giving out this stamp. You will most likely receive the EAD before the green card. Hope the employer will be happy with that.

An EAD card is different than a stamp. The stamp is given IF the office will do it, and not many will...as they say they're phasing it out as GC's come so quickly in the mail now. Anyway, your EAD card will suffice. You get that, so that you can legally work until you get your GC. You can't get your GC without an interview, or your file is transferred to California. I'm sure if you took in your EAD card when it comes, they'll accept that. Sometimes it takes months after your EAD to get your GC.
