If someone is here in the states on temp visa and is engaged to an america does the person have to go back to their country to apply for the visa?

It depends on a number of things. Chief among them is whether they intended to marry and stay in the USA at the time they last entered the US or the decision to marry and stay came after the last entry. Which is it?
