Here's the scenario:


My friend got married here to a US Citizen. She has a child from her former husband (she has her annulment papers, the child is using the father's last name). Now, she has a baby to her current husband under the hubby's last name. Which Visa application can she apply? what are the advantage and disadvantage of it??

What criteria is most important to the petitioner/beneficiary? Cost? Speed? Ability to work? Travel?

Each visa has different benefits. Best thing to do is read the guides and based on what list of important items might make the decision..

Both visas need an I-130 for each visa applicant. Either now or later. Get the I-130 prepared and filed first and foremost.

maybe the criteria is the speed (of course).. so what to do first?? coz as for me (I'm K1 visa and it's different from the K3 and CR1), so I don't know what to advise her

CR-1 - I-130 petition. One each for each potential visa applicant (Spouse and first child). This assumes the second child has claim to US citizenship.

K-3 - I-130 (filed above) then I-129F.

Since both petitions can be active concurrently, you can do both and then wait to see which one finishes first.

If you are going to advise then READ THE GUIDES... If not then the USC should join and READ THE GUIDES. Your friend cannot begin this process. It is the responsibility of the USC.
