Full Version: Ok, applied for k3, says CR-1 visa class on letter!!!

Ok guys, I just read the letter that I just recently wrote a post about and I am panicking! I thought this AOS stuff comes AFtER he comes to the US on the K3 visa. My visa classification says CR-1 on this letter that was just sent for the AOS Fee and choice of agent!! If anyone can clarify why my visa classification is changed when my case has already been forwarded to the embassy, please let me know! thank you!

Hi Heather, you are nervous today. Relax and take a breath. The NVC will continue to process things for your I-130 while also processing the I129f. The papers you received are for the I-130 which goes with the CR-1. Fill them out and return them. They won't interfere with you K3 129f.

Yes I know, lol, I am just trying to figure out the best route. Does CR-1 take a lot longer than the k3 or not that much difference in length? Yeah, I'm just nervous because I'm a silly person that likes to plan stuff out, but can't do that for the government!! LOL

1. Administrative Closures of I-129Fs? – One caller noted that USCIS’ National Customer Service Center is providing different information on the I-130/I-129F process. One customer service representative stated that the I-129F is administratively closed after the I-130 is approved. Another representative stated that I-129Fs are not closed and USCIS is continuing to process the I-129F. Is USCIS administratively closing the I-129F application if the I-130 has been approved? Can USCIS provide clarification on this process?

USCIS Response on April 30, 2008: USCIS has been administratively closing the I-129F upon approval of the I-130. USCIS, however, is currently reviewing the I-129F/K-3 process."

Try to stay calm and find out if they have cancelled your 129f. Some people are allowed to choose between K3 and CR1's and other are not being given that choice.
There are a few people on the board that have gone through/are going through this.

In this context, "AOS" refers to "Affidavit of Support". If you want the K3 visa, just ignore all correspondence from NVC regarding your I-130.

I'm virtually certain that they administratively close the I-129F when the I-130 is approved, which is a huge pain for some of us (i.e. if your husband lives next door to the embassy that would issue his K3, but has to take a day-long bus trip to the CR-1 embassy, hypothetically speaking, of course).

I'm about a month ahead of you in the process, and here's my advice: collect ALL of the papers that you'll need for the I-130/CR-1 and just plow ahead with that. http://www.visajourney.com/forums/index.php?showtopic=136822 has a lot of really useful info

(as further proof, see my timeline below. My I-129F was accepted to be expedited, and they haven't touched it in 2 months, so I'd say with certainty that it's been administratively closed).
