Dear VJ Family,
My uncle traveled from Panama to the U.S. on a visitor's visa. He had to attend my grandmother's funeral (March 1991). While in the country, my mother filed for her brother to remain in the country. I know that for siblings the time period is ten years. At any rate, my mother has no case number nor paper work to prove that she filed for my uncle. A few years ago, my uncle had been contacted by USCIS (formerly INS) advising him that the quoting was approaching. The problem is that my mother gave her brother (beneficiary) all of the paper work. He never followed up. Now 17 years later, my uncle has no green card. She doesn't know if he had been approved for a green card or not. Does this mean that my mother has to re-file for her brother? Please advise.

Your mother has to call the USCIS and give them all her info and the info of your uncle to see if they see him in their system. They will ask her things such as Full name, DOB, etc. for both of them to verify if a petition was filed for him. If they find him, they will advise her on what to do next. If not, then she will probably have to file all over again. If she does, make sure to make copies of every single piece of paper that is sent to them just in case.
