We received the paperwork for the RFE today.

They are requesting an I-693 Medical exam again.. this is what it says..

A review of the record indicates that you entered the US pursuant to a valid K1 non immigrant visa. All USCIS records relating to you have been reviewed. The US Department of State medical Forms DS-2053, DS-3024, DS-3025, and DS-3026 are not in any of those records.

Does this mean they lost the medical records?
Isn't the medical exam the contents in which was given in the sealed brown envelope at the port of entry was???
Do we have to get another Medical exam?
What are our options regarding this matter?
What are our rights? If we have any...

Yes it appears they have misplaced the medical... It happened to us.... Some have protested (via congressman) with limited success. We decided to bite the bullet rather than fight for a protracted search that may or may not have been successful. We did not want to delay the green card.

They might have misplaced it or your other medical was deemed too old. Just go get another one.

Yes, it means they lost it and you will need to get another one. Another VJ member who had the same thing happen decided to fight it - and ended up being denied! She had to file a motion to re-open the case - and provide the new medical. It sucks, yes, but once you get the requested medical to them you should receive your approval very soon afterwards.

You might want to get moving on scheduling and taking the medical exam - then use your congressman to get your fees back for the 2nd medical. Let them do the legwork. If you have receipts or something from the 1st medical, send that to them to try and get your medical costs reimbursed. Its probably not worth the effort or time to fight their mistake and delay taking the 2nd medical.

Thanks everyone! We will "bite the bullet" and get another exam, our appointment is Friday. Wish us luck! headbonk.gif
