Hi all,
I hope someone can help......
I am here in the US on an employer-sponsored H1B. I got married on Saturday to my new American wife. I am at an advanced stage of negotiation with another US employer who wants to to begin working for them immediately.
Upon speaking to my attorney this morning, I learned that to get my EAD can take 90 days, which is a problem for me.
Does anyone have any ideas if there is a way to speed this up or begin working for my new employer quicker than this? I do not really want to transfer ("port") my H1B - I have told my new employer that the visa will not be an issue, I thought it would only be a couple of weeks to get my EAD (my mistake - I was a little naive in truth). By the way, I am in California, Los Angeles to be exact.
Thanks in advance,
lukecloser

No other option, could be 2 months rather than 3 months, but 3 is the safe assumption.

Thanks, that's bad news.
Am I correct in my understanding that you can only apply for an interim EAD after 90 days has passed?

You need to file for your EAD as soon as you can... there is no way to speed it up that I know of...

90 days from the date of your receipt. So add on the time to file the papers and for them to acknowledge.

When it comes close to time for your biometrics appointment, make sure to stay away from sharp objects. I little misshap in the kitchen caused us to have to reschedule, and two more months of waiting.

lukecloser,
Word on the street is that the DO in LA is one of those that puts a hold on the '90-day clock' for the time waiting for the fingerprinting to be done.
Google the Usenet newsgroup <alt.visa.us.marriage-based> for posts on the subject by folinskyinla.

No "fast way" really. The sooner you file for AOS, the sooner you'll get the EAD.
So make sure you have all your and your wife's supporting documents (birth certificate, divorce decrees (if any), medical exam, etc). Some of that can take time.

I am in a similar situation as you as I am on a H1-B, getting married next year, and I am looking to change jobs soon after the wedding and the paperwork is in.
How are things working out?
Cheers,
