i was given a 90 day Temporary Employment Authorization at JFK, and had filed SSN at local SSA office which they told us they will mail in 2 weeks time.
the Employment Authorization will soon expire sometime September, our question is that, do we have to file for EAD same time we file our AOS? we are goin to file AOS first week August.

You can't file for your EAD based on your AoS application before you send the AoS application in. You can send it later though, if you wanted to. They don't have to be sent at the same time.

You can't file for your EAD based on your AoS application before you send the AoS application in. You can send it later though, if you wanted to. They don't have to be sent at the same time.



It's better to send the form I-765 (for EAD card) in the same time than the other forms, USCIS offers us a good bargain ( crying.gif the cost is 1010 dollars for the 3 forms ), if you send them separately, you will have to pay more.

Simple answer - if you want to keep working after your temp EAD expires, then yes. Simple question - why wouldnt you apply for it since its part of the overall fee for AOS?

There is not additional fees to pay if one file interim benefits separately after filing for AOS.

if you file the AOS you pay $1010. if you later file for AP and/or EAD you dont have to pay anything more

It is recommended to apply for the EAD along with your AOS. My fiance and I are currently facing the problem of being jobless for a little while which will make things a little hard so we are hoping to get a year EAD soon.
