My Mohammed
When the DCF says, 6 months continious residency what exactly do they mean? This is Cairo, Embassy i'm speaking about.

Do they require you to be married the 6 months and live with your spouse those 6 months?

Do they require a Residency Visa for Egypt and you have not left Egpyt for 6 months before you can file?

Can you not have left Egypt at all during the previous 6 months before you file DCF?

I'm sorry so many questions, but i'm just beginning my journey and don't understand this all. smile.gif I have been in Egypt since Jan of this year, but i've left 2 times to visit in the U.S. My husband and I chose an Orfi marriage when I arrived in Egypt, as we had no other choice at that time. I'm now trying to get the paper work together to get married at the Ministry of Justice. LoL .. having problems there too.

I'm just trying to understand exactly what they require for the 6 month residency. I have emailed them it's been a few days ago, but not had a response yet. I'd appreciate your help.

I cannot say for Egypt, but in Ireland you need to be a legal resident, and have a stamp from the Irish government in your passport giving you "leave to remain"- ie not just as a tourist. While you need to be a legal resident, it is perfectly ok to travel to the US (or elsewhere) for business or on holidays during that time. You need to be married for 6 months, and after those 6 months you can file (and the USC can leave for the US right after filing- quite a few people do in order to establish domicile, get a job etc). Thechnically, you do not need to be living together but I'd say if you have different addresses, that would be a red flag and cause some stiff questioning at interview.

I'm not sure about Egypt but the residency requirements for Australia are:

QUOTE
Under the revised procedures for filing petitions outside of the U.S., embassies and consulates may resume accepting I-130 petitions from American citizen petitioners who have maintained continuous residency in the consular district a minimum of the preceding six months. Petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so for at least six months before filing the petition.

Exceptions to the petitioner’s residency abroad requirement can be made only in cases of true emergency such as life and death or health and safety or when in the national interest. Examples would include minor children who would be unexpectedly left without a caretaker. Family reunification or new marriages alone are not emergencies. Examples of national interest include facilitating the travel of United States military and other U.S. government direct hire employees assigned overseas who are pending imminent transfer on orders and need to petition their spouse and minor children at posts overseas. Individuals who are in Australia on a temporary status, such as student or tourist, would not be considered to meet the residency standard.

In order to prove this we had to provide photocopies of my husband's valid Australian visa and his arrival stamp into Australia.

hi
im a lawyer and i have alittle bit good knowlege about DCF and some cases
ask me if you want anything maybe i can help

being back to usa 2 times this cut ur timeline as 6 month temporary residency
ur 6 month have to be all here without going out Egypt even for 1 day
my wife here from 3rd of feb till now she didnt move
and to proof the residency there is only one way
- (make ur husband take u to the ministry of immigration and passport (gawazat office )and let him ask that he will marry u (as ur just fiance now ) and dont talk about orfy or anything.
say exactly words ( i want to get married from my fiancee and she got 1 month tourist visa (the one in ur passport with 12 or 21 $ i dont remember ) and the office of foreigner marrige send us to you (the office ) to have 5 more month residency so we can be married (cause its necessary to start ur marriage).........
she will tell him go and pay about 12 L.E stamps in next window and she will give you another 5 month (stamped in your passport ) with expired date and no permission to work.
and she will tell u after u have ur marriage paper come and take 5 years with 265 L.E in her passport
(and ur free to take those 5 years or not cause after having a marriage paper no one can ask u about proof of residency ..i mean the airport or police station .....they will deal with u as egyptian cause ur an egyptian wife ....
so now u can copy that stamp on ur passport and the 1 month toursit visa this equal 6 months recidency

and if u want me to scan the stamp so ur husband can see it give me ur privet email and i will send it ..

and to know every small detail about getting married go to
http://cairo.usembassy.gov/consular/acs12.htm

and do what they say step by step and dont miss a single step cause this will REF him

your orfy will be through in the trash cause the only marriage they accept for immigration is the legal marriage ...im sorry but im a lawyer and i know that very well cause even egypt dont belive in orfy ....we just do it as a first step and maybe he will need it in the office of foreign marriage in ministry of justice ...
after the problem that happened between us embassy and egypt ministry of justice and cause that problem they have stop the affidavit of marrige ...but its back now and i was one of the first ppl who field it after it show up again
so they need it to correct the affidavit of marrige that us embassy give to u cause it have unleagal part at the end of it say (and the embassy have no deterrent to intimate this marriage )
and its just written in the arabic translation that they give it to u ( stupid translation office work with embassy)
thats why sometimes they make u go field an orfy (illegal marrige) 5 minute before the legal marrige to complete the form that law need it and to blind the hole in our law ( this is funny i swear )

for any information pls contact me and i will reply u
cause i allready did alllllll that and im waiting for my 6 month to end inshallah at 3rd of august so we can reserve interview for petition
and for now im searching for a way to have a sponsor

GOOD luck and contact me if u want to know more
haythamandfati
the 6 months of residency the embassy need start from the day u entered Egypt not the day of being married ........
