Full Version: Abandonment of Petition

There are a few questions I would like to ask, and I ask a few of the people in the know who are willing to share their knowledge to do so.
  • Who should be advised when withdrawing our visa petition?
  • Do you have an address where the cancellation should be sent? In case it is different from Montreal or Vermont.
  • After the cancellation would there be a time when admittance to the USA would be denied.
  • If possible, how long after cancellation of the petition will travel to the USA be permitted?
  • How long approximately would it take for the cancellation request to be processed?
We are not abandoning each other; that is not the purpose of the withdrawal of our petition, we are abandoning the process. We have little to no confidence in the American government making a decision on our behalf within the time it will take to have the Canadian government to process our petition from beginning to end.

The easiest way is to just abandon it from your end. Move on with your life and don't respond to any further inquiries from USCIS.

If you want to do it 'right', you should notify the service center or consulate or district office that is currently reviewing your petition/application.

Thank you VJ Troll, We will do it the right way so they have no reason to complicate our life in the future, we are currently in St Albans.

Ron, I just wanted to add that after the crap you've had to deal with I'm glad that you've moved on to what is right for your relationship with Sharon.  I'm torn between telling you to scuttle the ship or fighting on.  If you withdraw your application I don't think it will change your admissibilty if you didn't have any problems before.  You've put so much effort into this venture I think that you should continue on with US immigration and simultaneously pursue Canadian immigration as vigourously as possible.  The decision is yours but once you get the approval in the US, you could always choose which country to call home.  Whatever decision you make will be the right one I'm sure. good.gif heart.gif

Like most have said, I hope that whatever way you choose is gonna let you be together as fast as possible... It would be about time something gets done and I hope that the Canadian immigration is gonna be faster for you than waiting for your petition forever.

except that if you have concurrent applications going and USCIS finds out about the Canadian one, they'll just cancel the US one out of spite tongue.gif There was a couple on (I think it was) the Can/Am Yahoo list a couple of years ago that happened to.

I could say I am sorry to hear what you are about to do, but hey, you are taking your power back!
Congrats about that.

If you could just let it ride itself out to the end - perhaps an approval - then think about doing that.
I hope someone here can guide you about this.

And being that I have A.D.D. (self diagnosed), I cannot remember if Sharon ever contacted her congress person and/or thought of going to the media/press\ with this predicament.

In the end, I am so pleased for Sharon that she will enter a country that will take of you both in the long run; and so pleased for the both of you that you will be together and recover from these past government inflicted pains.

May your road there be safe and paved with rose petals.

Our hell was and is no worse than yours, in fact what we went through was less than you both have been through, I hope it will all come together for you very soon.
If Sharon hadn't been so sick and gone so much in the past year and needing me there this would not have been so bad, her needing me and my wanting to be there with her to make things better for her and not being able are what made this so difficult.

The fight is over, we had no clue as to when it would be over one month or thirteen months from now when we could be together. This way we can apply for her to be here and she can live here and return there when it is necessary and if everything goes well she could have her permanent residency as soon as six months from now if this take longer the bonus is they we will be married and living together not apart. To have stayed with the process to go to the States I would have had to redo the medical,the criminal ground check, hotel, interview and the trip to Montreal & back. The need to cancel the process was to be able to enter the States ASAP so we have smooth sailing when the time to moves comes.

Even if not faster it well still be a lot better since we will be together, can't ask for more than that.

The letter was delivered by UPS therefore there is no double petitioning to worry about. Didn't want to get barred from the US just yet, next year they can barr me til heII freezes over, I'm fine with that but will miss Colorado.

We thought for a second or two about sticking with it, but we waited 4 year before filing and have been in the process since September 06 and didn't want to be in it til 09 anytime. It was a very easy decission for us to make, the only person we contacted was the ombudsman and their reply was we can't help you but you should hire a lawyer. The good thing is that in Canada my past will not will not interfere with our future as it has with the States.

We think so aslo but the good or best part of it is that our lifestyle change will be minimal, Sharon is coming to a foriegn country where the the scenery is the same , the foods the same, she will be trading Spanish for French which is no problem she will have no need for either.

I can only redouble what Len and Spirit and so many others have posted and what we all know in our hearts to be true, providence has favoured Canada by allowing you, your love and humanity to flourish in the face of bureaucratic obeisance and misguided loyalties.
