Ok, as they say "knowledge is power". Lets get a list together here of everyone that got NOA2's that have NOA1 dates of March 6 and later. Include the type of visa (k1 or k3), the country for the fiance and the service center. Also, anyone that had an approved petition returned to the service center please list that and the center you used.
I will try to put it in some sort of form so we can get a better idea of what is going on. We will also be able to track the progress of the centers as they try to deal with this. I know that some of this can be gotten from the timelines but the returns and the dates they are sent back are not there.
At least we will be able to get an idea of what is going on this way and it will also be good therapy for me as I sweat out our NOA2.

I'm confused about even if we know the official date(s).
NOA1 has a receipt date 3/1 and notice date 3/7.
NOA2 has a receipt date 3/7 and notice date 3.8.
I had one reply to my question that the real date and time is what's stamped on the Petition.
How do we know that?

My NOA1 is February 28, 2006 when i checkthe Online status. Got the NOA1 actual letter i the Mail on March 2nd.
My NOA2 is on the MAY 1, 2006 when i checked online Status and i recieved it in the mail on May 6, 2006.
Am I affected by the IMBRA????

So far, I can only see that there was nothing done out of Nebraska on K-1 all of last week...

I haven't received any notice...it will be interesting to see what volume of "notices" have been going out to people?

I have been watching the processing out of Nebraska as well and it seems that they are pretty slow. Still trying to figure out how this new law is going to affect times. I have also noticed that nothing as been done with my application since it was received on March 24th. Is it common not to even have your application touched??[color=#3366FF]

Our application's status said updated 3/03/06, until it was touched AND approved on May 8. I don't know if they approved the application in one day, or it they just didn't update the status.

But if you break the law and do things illegally you are rewarded (refering to certain group of 11 million people who just protested for their "rights" and will be given citizenship because it is the "humane" thing to do)

Because it is USCIS policy and procedure.
My reply to you on this from another thread.....I have copied it to save rewriting
The receipt date on the NOA is the day the service center physically received your petition which is the date-time stamp on the petition. The NOA Notice Date is the date it was entered into the system and a NOA generated. Anything to do with your process including guaging whether your case is overdue is taken from the receipt date (the date it was phsically received at the service center)..not the NOA notice date. The NOA2 has nothing to do with whether you will or may be affected by the IMBRA. Any petition received after March 6 (the date stamped on your petition which is the receipt date on your NOA1) are the ones affected by the IMBRA. As your receipt date is 3/1 then you filed before the Act came into effect and should not come under the IMBRA.
From a post by desert_fox in response to the question. If you read the text it refers to what I state above.

: Due to an unusually large volume of receipts at the Service Centers during the first week of April, it is taking longer than expected to enter cases into the system. Depending on the type of case and service requested, it may take approximately 14 days to generate and mail receipt notices. Once the receipt notice has been generated, it may take an additional 2 to 3 days for customers to receive their receipt notices in the mail. Per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days.
USCIS wishes to assure all customers that the original received date will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated. USCIS has taken appropriate measures to address this situation and expects to be current with its receipting by mid-May.

I think it's just a matter of numbers -- 11 million people can demand virtually whatever they want, even if they're here illegally. That's 11 million people who probably have family members and friends and supporters and sympathizers who are USCs who will vote and influence elections. I don't know how many people apply for the K-1 every year, but it's probably a much smaller group than 11 million people -- and so, we matter less to most politicians. This is complete crap. Also, they probably figure that if we're going through all this trouble in the first place, we'll take whatever new laws and restrictions they throw out and continue to wait and follow everything to the letter.
It's funny because this new law probably is really a "good thing" because it aims to protect foreign women from abuse and I bet most people would be in support of it, but the way they're going about enforcing it is SO ridiculous and heartbreaking and it does seem like they're punishing people.

The NOA1 Receipt Date is the one that matters, not the NOA1 Notice or the NOA2 Receipt Date.

Any word on how this will affect those of us with NOA1s after March 6th? All I can find is "if you are before March 6, don't worry. If you're after March 6, you're screwed." Probably true but not very specific.

I sent my 129f on March 10 to VSC, received NOA2 on March 24. NVC has already completed processing and my financee already received her packet from the Moscow Embassy. Her interview is set for June 13.
I was after the March 6 date completely, and it moved fast for me.
My only concern is that USCIS will re-assess their approvals made after March 6 in order to conduct the criminal investigation and such. I have not heard any word about people getting their approvals "revoked" yet, but would be interested to know if anyone else has heard such a thing.
I highly doubt that the USG has the energy to revoke the approvals made after that time...they are probably still trying to figure out what to do with the ones coming in.

Not screwed.....the ones affected are those that have met through a marriage broker and/or have filed multiple petitons etc. If you havent already....have a read of the act in various threads pertaining to the IMBRA. Right now I think there is a settling in stage which may have slowed things at the various service centers including NBC.
I am wondering, particularly now, how important it is going to be to write more then a few words when it comes to Q18 on the I-129F as to how one met especially if one has met over the internet. Whilst meeting online itself, in various chat rooms, groups etc do not seem to come under this act.....how are they to know if one leaves too much to the imagination. My advice is to perhaps go into a lot more detail under these circumstances to safeguard against being caught up in it. Any thoughts?????

I would caution people who are thinking that this applies only to either those citizens who have applied more than once or marriage brokers. It applies to all petitioners.
Read Section 4 of the Act
SEC. 4. CRIMINAL BACKGROUND CHECK.
Section 214(d) of the Immigration and Nationality Act (8 U.S.C. 1184(d)), as amended by section 2, is further amended by adding at the end the following:
`(3) A petitioner for a visa under clause (i) or (iii) of section 101(a)(15)(K) shall undergo a national criminal background check conducted using the national criminal history background check system and State criminal history repositories of all States in which the applicant has resided prior to the petition being approved by the Secretary of Homeland Security, and the results of the background check shall be included in the petition forwarded to the consular office under that section.'.
That criminal background check should be completed prior to the approval of the 129f, and applies to all applicants (US Citizens). this is not part of the process conducted by the USCIS currently, and so they need to change proceedures at all service centers to get into compliance. In short, the law does not just regulate marriage brokers, it also strengthens the review for all applicants.
The question is, is the USCIS going to rescind approvals for 129fs received after March 6 in order to conduct the now required criminal background check on the US petitioner, or are they going to just hold up the process from here forward as they start conducting the background checks?
If someone has information about an interview that was scheduled and cancelled because of IMBRA, I would appreciate some info as it may affect me as well.

You're right; they actually cannot know; the presentation of evidence could be spoofed to the point of looking real. It'd take an enormous amount of investigative time if someone knows enough about the technology. If someone's legit, then they can just be open, not give more than needed, and not less than asked for ... assuming you can figure out really what they want.
I just read yesterday that they questions are worded vaguely on purposed to lay potential traps so people will submit more info than needed and they start a file on tagged red flag info that you didn't need to submit anyway. Perverse!
We met on a "dating site" not via a marriage broker.
There was no suggestion of "find a wife, bride" or anything else like that on the site.
What I did for the I-129F package was take most of the first emails from each of us to show the initial establishment of contact clearly, printed them, and included them in the other supporting information.
My answer to that Q I wrote based on an advisor's recommendation: keep it simple. This was the old form if there's a revised one I've not looked at it so my answer may be not for the correct Q.

Not doubting you at this stage but I am struggling to find the text you quoted in the IMBRA here

I think, it is hard to say at this point how it would affect all. First of all, USCIS needs to modify the I-129F form to have additional space for the USC petitioner's background check. USCIS still has the same I-129F form in their website. Now, what will happen to those petition by USC who already filed and received NOA-1 even after March 6, 2006 with this current I-129F form? Maybe USCIS will perform background check on them. One only needs name and date of birth to conduct a background check.
Now, Q.18 on I-129F is only applicable to K-1. Instructions say that K-3 should write it as "N/A." Does it imply that this whole background issue is focusing on mainly K-1?
The IMBRA information also says that during the interview, the Consular Officer may reveal to the beneficiary that the petitioner has violent criminal background (sexual predator and other serious crimes) so that the beneficiary can think twice whether to continue this relationship or not. Of course, no one should give his/her daughter/sister to anyone who has violent or serious criminal background. If someone is engaged, then he/she can decide not to get married, but if someone is already married to the USC petitioner, then what he/she would decide? Divorce?
The whole IMBRA issue is not very clear to anyone at this point.

You are correct, I did have an old copy of the Act.
I checked on Westlaw for the final version. Congress basically requires that the 129f have a section disclosing criminal background information.
It is unclear if they need to conduct an investigation or not.

I have to agree here. I have a gut feeling in my stomach that they are just more cautious about you if you met online. How can they know which site is a mariage broker or not? I did not specify this in my answer to question #18. I NEVER thought it could effect me so much!!!

We met online on a free Russian site, so I think they just panicked because Russia has a tendency to utilize the mail-order bride routine. This is just a hunch......I dunno

There should be a way to do a proper table with cells and such in BB code but I just haven't found it yet.
Jaylen Brit, did you just choose the [code] tags and then the spacing stayed with the table? Thats kind of cool if that is the way it works. I wonder if there is a way of changing the "code" name at the top?

GaryC your a champ for doing this. I was really starting to get panick seeing these interviews getting cancelled. Should hear about my interview in a week or two by past standards. Please add us too.

Hey all.
I just spoke to the Embassy, and my interview has not been cancelled. I will confirm with USCIS shortly that my NOA2 has not been rescinded.
I wonder if during this early implementation period for the new law the USCIS is taking a case-by-case look to determine if to recall the NOA2s?
What would help is if those who had their interviews cancelled could provide some info as to whether they met their fiancees online, through a broker, or on their own. We may see a pattern then. If you don't want to let us know this, totally understandable.
The law applies to all petitioners, in so far as we all need to have our criminal records presented to fiancees, regardless of whether or not you used a marriage broker. But still, the USCIS might be looking at this in another way for the interim period until they can get it all in line.
I met my fiancee while working in Russia as a federal employee for the Embassy (although I am not one anymore), so they might have let me slip by. Did not use a broker or the internet. But that theory would only apply if they are doing a case by case look at things, rather than a complete "recall".

Maybe you're right about this. But I wonder if there's any pattern thus far connecting how couple met with whether they've been affected by the IMBRA or whether they wrote a lot or a little in Q18.
What I don't get is the people who have NOA1's before March 6th getting their stuff returned -- they're retroactively enforcing a law that wasn't in effect at the time. At least for petitions that got the NOA1 on or after 3/6 they could say it's when the law technically came into effect, but before that ...

even if the NOA1 was recorded on March 5th 5 minutes before the SC was closing, the law still wasn't active at the time.
Ahhhghghgh-- no rhyme or reason !

I attached a two-page letter further explaining how we met on the internet and our history together. Hopefully that will rule out any suspicions.
So far, there isn't enough people affected here I don't think to see a pattern unfortunately.
