I don't know how well this information will help, but I just spoke with the company that filed our petition for us. I talked to him for fifteen minutes and he said the new law effects those who met each other thru a marriage broker. He said that the petitions that are getting returned, probably have to do with their answer they gave in how they met. If the answer given doesn't exclude the possibility of a marriage broker, then yours may be effected. When we filed ours, I stated we met while visiting Vietnam, because this is actually where we met, and they are not asking you how can you meet in Vietnam, just where did you meet. There are two questions usually at the interview. One is how can you two meet, which would be on a dating site, or thru friends. The other question is where did you two meet, which is the same question as on the I-129F, and your answer would be where you actually met each other. I did not use a broker so I think I am in the clear.
So for those cases that have been returned or interviews cancelled, if you would be willing to say, can you tells us your answer to the question on I-129. If you just said met online, that leaves the door open. I think this information would be the most useful in figuring this out.
You can ad my name to the list using my signature if you like, but I haven't been told that ours has been sent back. We are still expecting for our to go smoothly.

Hello, everyone,
My finacee and I recently recieved our NOA2. I am in the process of organizing and gathering things for the 134.
My question is this... She lived in New York city for 4 years. She overstayed her visit by 3 years.
I have a feeling she might be questioned about this at her interview at the consulate.
What should we do? Hire an attorney (God forbid)? Fake it? Or what?
She was a student and worked part-time. She did not commint any crimes or whatever.
Has anyone here been in similar circumstances?

The USCIS "asks" how you met in the context of a phsyical meeting to determine the validity of the claim you have met in person. It's not relevant to the question (18) if you met via IM or e-mail at the 129 petition stage. I assume if you met in person via a marriage broker than maybe that will raise the red flag.

Here's my information (and Bstnguy's too, since he's my fiance):
K1 ... Canada ... VSC ... NOA1: April 18 ... NOA2: April 24 ... no interview scheduled yet.
I received my packet 3 from Montreal on May 10th, and my fiance was notified that our petition was recalled because of IMBRA on May 12th. The Montreal consulate advised me not to send in the packet 3 stuff (checklist and DS-230) until the petition is re-approved. I also postponed my medical exam, which would have been today.
Bstnguy and I met at a lacrosse game in Toronto (and stated that in our petition) so it's unlikely our petition was recalled because they were concerned we met through a marriage broker.

I must have called the NVC, USCIS, and the embassy abroad a dozen times today!!!!!! They all seem to be pointing the fingure at each other. And finally I just told the very nice gentlemen on the phone at the USCIS
I WANT TO SPEAK TO THE PERSON WHO IS INTERPRETING THIS LAW!!!!!
I would really like to! He was a very nice man so I didnt feel right to hang it all on him, but really I think some bozo just picked up my file and said, "oh so they met on a russian website, well then we should check it , it must be what they mean in this new law!"
I am so frustrated with no one ever READING!
When I told the woman at the embassy that if our cancellation was due to this new law, they have made a mistake because it does not apply to me. she was taken aback, and asked why not? I told her because I did not meet my fiance through a Marriage Broker, she seemed surprised and later just said it makes no difference it has to do with the date of your petiton. She wasnt very nice to me AT ALL!!!!!!!
Like I said, I want to talk to the person who is interpreting this law and causing all the delays!! I have a hunch its at the embassy, but I will never know for sure, this is the sad part!

I called USCIS and got transfered about 5 times and talked to several people before finally getting an immigration officer. He said he wasn't familiar with this new law so he looked it up and said that he really didn't know anything about it and that it isn't uncommon for them to be the last to find about these things (???). Anyways all he said was that for my case, seeing as it was approved on May 8 that he didn't see any reason that it would be sent back after reaching Morocco as it is still in the US. That doesn't help much I know, I'm sorry I wish I had gotten more info.

it will not apply to you. This has to do with the nao1 date. mien was in jan. So I'm clear. though it makes littel diffrence. I don;t even have a trafic violation to my name.

Judging by the comments I am starting to get a picture here. It looks like this all depends on how you answered the question of how you met. If you said a IMB or gave an ambiguous answer then you get looked at. If you were specific about something other than a IMB then you go through. If someone has something different happen to them please post it.

As I mentioned in my post, we most definitely didn't meet through an IMB and were very clear in stating that we met in person at a sporting event, but our petition was still recalled.
In addition to describing how we met the first time, we also mentioned that he traveled up to visit me during the summer and supported it with the stamps in his passport (even though Canada doesn't usually stamp passports anymore, they were working to rule at the time), photos of us at a city-run event he attended that I coordinated (it's listed in my employment history), and AMTRAK stubs with our names on them from our travel within the US (and both purchased with his credit card). There should be no concern whatsoever that we met through an IMB. I hope this means we'll be re-approved quickly.

Sorry, didn't mean to make anyone more nervous... We haven't actually gotten the official letter about the recall yet, Bstnguy (my fiance) found out by emailing Montreal asking if we were likely to be affected. They responded saying a letter had been mailed to us stating that our approval had been revoked pending further processing due to the new law. We also called Montreal on Monday, and they told me not to send in the packet 3 documents until we are re-approved as they won't accept them at this time.

I think it's all random.
We'd need a larger sampling population to be able to draw statistical trends.
There are too, too many factors involved from random sampling [like do they take Petition number 11 an odd number from random countries], or is there more scrutiny for some countries [remember part of this deals with safety and security], age differences, how the adjudicator felt on a certain day [was it TGIF], was there pressure from the boss, did their head honcho or honchess tell them to interpret the IMBRA this way or that, how does Adjudicator A differ from Adjudicator B, is there a "god" adjudicator who has final word, how many processes does the Petition pass through before final adjudication, is that number different for different countries or situations [obviously if you get at least one RFE it is], did someone [who knows] fat-finger something that derailed your petition ... just too many factors.
I believe, I feel we're in a crap shoot -- for those not familiar with the term that means rolling the dice.
Let's just hope not too many come up craps on a roll!

I hope everything thing goes well for us all. I just don't understand why they need to return the petition to the US. Don't they have our information on record at the NVC or USCIS, that they could just run name checks, and if something pops up with your name, then they can recall it, but if your name doesn't get hits then no problem. They should begin with names with the closest interview dates, and move down the line, therefore they would not have to cancel interviews, if your name doesn't get hits. It just amazes me how unorganized and how unproffesional our government is working. I would have assumed that they did a criminal backround check before approving the petition.
Good Luck to us all on our long Journeys!!! Wish we were all as lucky as those who enter illegally, but we are law abiding citizens, and we get the shaft usually.

Well, actually it makes more sense to me. Why would someone who goes through an "IMB", which is still loosely defined, be more apt at having a domestic violence background than someone who met their fiance through a chat room? They both should be scrutinized the same.

does seem only fair--and a lot less like profiling. But someone must have done some research and found out some grim statistics about IMB marriages in particular or they wouldn't have written the law in the first place. Although trying to fit logic into the legislative process is like trying to fit a square peg in a round hole.

Yes, I'm aware that the new law affects everyone. I was just responding to the comment that it seemed like the recalls were only affecting those who met through an IMB or were vague in describing how they met... we were neither and were still affected, so I wanted to make that clear.

When the senator from Washington thought up this law in 2003 a study was commissioned to gather statistics on physical abuse in visa-related marriages, and abuse of the system in general. That study and another subsequent study, found the actual number of confirmed abuse cases was so small as to be meaningless in the context of the large number of visas issued.
When she again tried to get this law passed in 2005, the senator didn't mention the study because it would hurt her platform of fighting rampant abuse of poor illiterate women brought to the US by abusive men. In fact, there were no hearings at all. IMBRA was added to the law protecting women act and there was only a voice vote.
When IMBRA was challenged, the study was brought to light. A federal judge issued an injunction against IMBRA for probably violating two of our constitutional rights. He also felt the law was overreaching and unfair in that it only covered IMBs. Since there was no statistical evidence that IMB marriages were prone to abuse, why not protect people who meet in brothels, or libraries? Why are international Match.com marriages exempt from the initial contact disclosure requirements of IMBRA? To be fair, the law should state that domestic women who meet domestic men in the US should have to carry a letter showing how many children they've had, every address they've had since they were 18, and that they're not in the sexual predator database.

Our case has gone all the way through the process and just before picking up the visa it was recalled!!!!!

Well, my NOA1 was dated 4/10/06, and my fiance reports receiving Packet 3 today. So I'm hoping that means we aren't being affected by IMBRA.

My fiance manage to talk to someone from VSC on the phone, they told him my case is not the only one... they are recalling at least 1000 approved case from VSC now... they are still waiting for further instruction, at this point they have no advice on what is require yet, we need to wait....
The only thing we can do now is contact the congress office and senator for help to pushing the case to move on....

BTW she was FULLY APPROVED!!! All they had to do was put her visa into her passport when they called her to say it was being held now.

Ok, I am starting to get worried now, because my case came thru Vermont and got my NOA1 after March 6. This is totally ignorant of our government. If the law was in place on March 6, and we didn't have our NOA1, then why wouldn't they do it before approving it. It makes no sense. They install a law before they even know how to put it into effect.
We need to get this issue into the public eye, just like the illegal immigrants in the US. This is totally unfair to us as US citizens. We need to take action, instead of sitting here taking every punch they throw at us. I guess they rather us do it illegally than legally. Look at all the money they are wasting on just this new law they have. To recall all the petitions is absolutely criminal.
