Although it´s in review the one thing I liked about it is that it says it´s in emergency review, which shows that at least they´re trying to put it up fast, this new form, and from what I understood, it seems they might make it e-fillable or something, to faster receive and process it.

All it means is that there is an I-129F coming. Whether that is good news as to the IMBRA is anybodys guess. That would depend on if there was extra questions added pertaining to the petitioner and the background checks.

I´d think so as that was pretty much what was said in that memo from the department of state, that a new form would be issued.

They are just incorporating the old language into a new I-129F.

This is already asked in the question of how you met in the current I-129F.

The only thing new is the possible queastionnere being sent to K-3 as stated earlier above for right now.

It appears it may be just looking for input on the current form and as a possible document review. The form it points to is dated 10/26/05 and it expires on 06/30/06 so they are reviewing the documents as per a time line they have in place for validity of these forms.
So if there has been no changes and the current form is set to expire shortly then it does not appear that a new I-129F is something that is going to be needed so as mentioned it may be a seperate questionaire or something along those lines by the looks of the time frame they have setup.

All it refers is to the current reason why there is a I-129F and the purpose of it. This is the wording when it was first revised years ago as to what information it would collect and what the information would provide.

Don't worry, our turn is coming soon. The current I-129F expires on 6/30/2006, so something is going to happen soon.

I think the information from the Federal Register that everyone is assuming refers to a new IMBRA-compliant I-129F is actually refering to the Paperwork Reduction Act. The PRA requires that they do this every so often, getting info on how long the forms take people to complete, how long they take to process, etc. I wouldn't necessarily assume it has anything to do with us.

My opinion (and its only MY opinion) is that they are slipping behind at an amazing pace. They will do something quickly or they will be in a world of hurt with a quicksand of new paperwork that needs to be done. I think we will see some action soon. And I also think they will make it as easy as possible to make it happen as quickly as possible. It won't be long and we will have something to fill out and send in.

It's the Paperwork Reduction Act that requires form revisions to be subject to a public review and comment period. The reasons for review of I-129f at this time may well include proposed revisions to implement IMBRA requirements.

I actually think this is NOT the info we´re expecting. The news in that other thread about CSC seems promising though.

EDIT: From that other thread. CSC told someone that they are sending a form regarding IMBRA soon. VSC told a different person that they have no procedures as of yet. Who´s misinformed?

Neither has a direct phone line to talk to the specific SC. We all call the same 1-800 number. It just depends on who answers the phone at the customer service center as to the exact wording of the information that is given to someone. Each service rep will tell their version at a given time.

If it was official, then each customer service rep. would give the same clear and concise answer (we hope).

That is not true, I did speak to Vermont rep (I was told that I am being connected to VCS and the lady on the phone introduced herself as Vermont customer service rep). I just do not know why you guys can not get to VCS using my method.

Im trying to figure somethings out in this mess of an IMBRA disaster.


It seems like all evidences that have been provided here are being disputed by everyone. So I guess is it true that at this point we dont have any answers as to how long the delays will take and to whether or not there will be a new 129F form? Or if the old 129F form will be fine and just an additional document will be created which petitioners have to complete?


My questions are:

Im waiting for a packet 3, its been 7 weeks and has not arrived. This week I will email the consulate in Buenos Aires to ask for the status of the packet 3. If they offer to send it or email it, does anyone think it is possible that it wouldnt make sense to complete packet 3 and also the expensive medical exams because possibly the IMBRA law may create an entire new 129F and PACKET3 which would in turn cause my fiance to have to undergo and pay for a second medical exam if the IMBRA law makes the old packet 3 obsolete?



Thanks anyway in advance for any responses. I hope not to add to the mess and confusion or to anger anyone with more possibly senseless questioning.

I didnt,and our interview was cancelled.
We met online on a russian FREE site. But from what i can make out, they do not care, they are recalling all petitions after March 6th, and I guess they will sort them out one by one ...all 1100 laughing.gif

I don't think it makes sense to NOT complete packet 3 and do everything else. The hope/dream/wish of everyone who has already filed is that we will receive a form to fill out and return and that will be the end of it. It would be VERY unlikely IMHO that anyone who has already filed would be required to fill out an entirely new I-129F but logic tells me not to write off any absurdity that they might come up with. It just wouldn't make sense that packet 3 would be affected. Either way, your medical exam should be good for one year. So I guess my thoughts to you would be to continue moving forward if you have the option to do so. Then you can just send in the missing secret form/questionnaire when you receive it. Hope this makes sense.

I received my Packet 3 from Montreal right before they recalled my petition, and Montreal told me not to send anything in until I hear from them as they won't accept the documents until my petition is re-approved...

That is the clearest thing ive read all day. Exactly I agree.


BEST CASE SCENARIO: A new additional form will be created into the process providing additional background information. We will fill out and send in the form as an attachment to our petition. End of story. That would make sense, that would save alot of time, that would save alot of heartache and stress.

WORST CASE SCENARIO: An an entirely new 129F form is created to include additional background information. This means all NOA notices 1&2 that have been recieved by petitioners are now void, useless and unrecognized by the NVC because they applied to the OLD 129F. This would take much much longer and set every petitioner all the way back to the beginning. That would make no sense. It would be stressfull for petitioners and service centers. It would be ridiculous.

My fiancee sent an email (I'm guessing she asked about the receipt) and received an email from the lawyer firm today:

Dear ******
Yes we got a receipt from the government, however the government passed a new law and some changes took effect last week. This may affect your petition and all the petitions filed after May 6th.
Contact our law offices for further information.


I think her May 6th date is a typo.

We first met online in a MMORPG (Massively Multiplayer Online Role Playing Game). She stoped playing. When she came back after a couple months I started talking to her to know why she wasn't playing anymore. I found out she quited the game but decided to log on to see if her friends were still playing. After chating for a couple of days we started chating on yahoo messenger (she then quited the game completely). After a while we switched to MSN messenger (yahoo sucks for the sound & webcam). We started really chatting in mid August 2003. I met her for the first time for Valentine's Day in 2004. Then she came to see me in August 2003. I saw her again for New Year's Eve in 2005, again in June and went there for 3-4 months in August.

That's what we put on the I-129F' questionnaire (well something similar).

I am SO looking forward to my trip starting friday morning. I am hoping that something happens while I am gone!
The backlog at the service centers has to me mindbogeling! They are gonna have to build new warehouses to put all these petitions that are just sitting there! God please help them get their act together soon. I am this close (fingers held one millimeter apart) to just staying in the philippines and finding work there! If I only could!!!!

Ok, fiance called the DOS and USCIS today.

I'll post the e-mail he sent me after he called.

"So, I called USCIS and DoS and here is how it goes. I called USCIS, got to talk to a representant, but this time it was different. It was weird..you see..they always ask your receipt number and your name and proceed to answer your questions normally. This time the women went like this...your name...your birthday...were you live? Your address? your zipcode? your fiance's name?were does she live? all questions a second apart...of course I answered all quickly as it was asked..but I found it weird...then she told me the IMBRA wouldn't hurt or halt the process and the the reason they havent gotten to us is 'cus they are at march 6 and I say how can that be last time it was different and she goes oh but that's what the machine shows...anyway...that was a load of BS why?
'Cus I called the DoS which were honest and helpful...the guy I talked to said look the law is halted the process a bit..but we are just looking at a month delay right now. Stay in touch for any changes."

Now we need to know if it's a month delay since the delay started or from today (that my fiance called). And USCIS is completely crazy.

Your address? your zipcode? your fiance's name?were does she live? all questions a second apart...of course I answered all quickly as it was asked..but I found it weird...then she told me the IMBRA wouldn't hurt or halt the process and the the reason they havent gotten to us is 'cus they are at march 6 and I say how can that be last time it was different and she goes oh but that's what the machine shows...anyway...that was a load of BS why?
'Cus I called the DoS which were honest and helpful...the guy I talked to said look the law is halted the process a bit..but we are just looking at a month delay right now. Stay in touch for any changes."

Now we need to know if it's a month delay since the delay started or from today (that my fiance called). And USCIS is completely crazy.

Well, let me tell you if its a month from the time all this BS started it should be coming to an end by now, I think we should figure a month from now...I'd like to think it would be a month from the time they received all the petitions back...but no way of finding out when that happened. no0pb.gif

I called USCIS today about not receiving my NOA1 for an I-129F which arrived at the California Service Center in late April (an entirely different issue). I asked about the affects IMBRA had on my application and was told something along the lines of "there is no need for me to request a background check from the FBI on myself and that DHS will handle everything". I got the impression USCIS will not be sending additional packets or new I-129Fs to current applicants. Instead it sounds like they'll just get criminal histories from other government organizations... I hope this really is the case good.gif

Oh boy! There are as many statements from the USCIS as there are colors in the rainbow!! I think they have NO IDEA what is really gonna happen and what they tell you depends on who you talk to. I wish they would get their act together!!

I really don't think signing that petition against the IMBRA law is a good idea. I have no problem with the law, just the way they are handling it and the timeframe. If you guys make a big enough uproar, then it is only going to prolong them figuring out what they need to do to start processing again. So if you want to add more wasted time to everyones petitions, sign the petition.

I think what was meant was that the legislation isn't the problem, it's the administrative failure that is slowing our petitions down. Once a law is enacted, the affected agencies usually have a specified window of time for promulgating new regulations to change their procedures in order to implement it. There is where we've gone wrong--they never got around to doing that.

Working at the legislative level by petitioning for the repeal of IMBRA really is taking the long way.

Let's suppose you were able to get enough support to convince some member of Congress that IMBRA has to go. Well, it's part of the re-authorized Violence Against Women Act, so this person would have to propose that Congress amend VAWA. That won't happen without a lot of debate on the House and Senate floors. Then the actual process of passing the amendments and getting the Prez to sign the amendments to VAWA. Congress is designed to move pretty slowly, and this wouldn't be likely to be a priority bill anyway. Assuming you even got to the floor (which could take years if it happened at all), I'd say 6 months, minimum, for Congress to act. Which is worth it if what you don't like is the law itself. But if your beef is with how everything's ground to a halt at the Service Centers, you are definitely barking up the wrong tree by petitioning for the repeal of IMBRA.

That, and the fact that with all the "male activist" buzz about IMBRA, your petition might end up getting filed with all the others from men's groups wanting the law repealed. The agenda at the legislative level isn't about hurrying the process along--it's about preventing regulation of the foreign bride industry and (they would say) the inappropriate disclosure of the petitioners' criminal histories to prospective wives. Might not slow the process down further, but it wouldn't result in anything moving faster either, because the people looking at it wouldn't be the people issuing the NOAs.
