I spoke with Vermont 1.5 weeks ago and was told that they temporally halting processing petitons until new
instructions received (my case has been in security check since April 20 and has a receipt date of March
8th). But last Friday I was told that my case is still in security check stage and lady on the phone had know
idea about new law. So I am not sure that Vermont have sorted out everything already and knows what to
do with any cases.

That should explain everything.
What should we do now?

My petition has not been recalled. I talked to the Embassy in Moscow today and to USCIS about it. They insist that we are still good for June 13.

We filed on March 10 through VSC, after the March 6 deadline.

Did USCIS say anything about that?

This is confusing! I thought all petitions that had gone through VSC were being recalled.

I also went thru the Vermont center, and I just called the Consulate in Vietnam. Right now we just received packet 3, so I just had her access our file, and asked some questions. Are file must still be there because she answered my questions, and didn't say anything about our petition being recalled. That is a relief. I really feel for all of those being affected by this, and I hope that the service centers will attend to these petitions first, and get them back where they belong quickly.

Now when I called NVC last week I received the same answer from them, that they simply forward the recalled petitions from the consulate abroad to USCIS. They have nothing to do with the decision to recall and neither does the embassy abroad. They simple received intructions from the USCIS to send back all petitions dated March 6 and after. The way I see it, USCIS will not be doing background checks on everyone, just on those that fall under this new law I believe. The other ones I think they will look over and see that they're OKAY and send back. But the reason they have to recall all of them is because they no longer know which is which. I AM NOT sure, just an educated guess.

As I mentioned in my previous post, I contacted my congressman, and already signed their permission slip to have them investigate. I called today to follow up, they have started an investigation and will let me know once they hear something. I hope its soon. I will keep you posted.

Guys, there´s a new topic with a link to a Official Statement from the State Department.

They admmit their mistake and say they will send additional documents to the petitioner so they can meet the new IMBRA law.

More delay, they say, and no way to predict of how long it will be.

Hopefuly the american citizens will be receiving this soon!

If I understand this right EVERYONE that has a NOA1 after March 5 will get returned.
Only if your visa has been issued will you escape the return and RFE.

Looks like the mistery is over and we are back to work.

This is all so very frustrating!! I keep checking the USCIS web page for information regarding my application and nothing, only the fact that the NOA was mailed out in March, no touches or nothing. I was hoping that Luisa would be here in the states with me by August, it seemed like a feasable date when initially looking at the timeline process dates, but now it looks like I will be lucky if she is here by Christmas!! I am all for Homeland Security and also protecting women from third world countries, but really find a way to do this without all the delays. AAARGH!!

I just check the processing date for VSC, it has just reverse back on 06 March 06.

I think it is good... at last they are now start working on the issue that get impacted by IMBRA... Hoping and wishing they are able to move thing faster…

Yeah, I just checked Nebraska. They moved theirs to Feb 22. The fact that they moved it is hopeful that they will start again.

Since we now know that K3's and petitions before March 5 will not be impacted the next time I update the list I will eliminate those lucky ones that will not be delayed. The rest of us will just have to sweat it out.

I just got this email from my lawyer. I emailed him the DHS memo and asked him about the RFE's that may be coming. This is what he said:

Lots of confusion happening within this thread as to the roles of USCIS & NVC (Department of State)

They are two completely seperate entities. USCIS cannot request Consulates directly to return petitions.

USCIS would of sent a directive to NVC to recall all petitons with a priority date (received date on NOA1) of March 6 and later.

NVC sent a directive to Consulates where the petitions in question were forwarded.

Consulates then send these petitions back to NVC

NVC will then forward these petitions to the service centers from wence they originally came.

USCIS will then do the required IMBRA checks

Petitions will then be rerouted back to the Consulate via NVC.

You can see why when you call either the NVC or Consulate, there is different things being said....because there is.......each is its own step.

Yes it is going to take some time unfortunately for all those that had petitions returned. It will also backlog centers such as vermont, which many of the petitions seemed to of originated. But they will catch up. Hang tight everyone and all the very best.

According to the memo there are 1100 petitions that need to be returned. If Vermont has ANY common sense (I know, thats a big if) they will put people on overtime to send them back. The rest of the service centers are hopefully getting procedures in place to do the extra checks. Time will tell.

If your received date on the NOA1 (not the NOA notice date) is dated 6 march or later.....it doesnt matter which country you are from........they are the ones that have been requested returned.....whether they were at Consulate already or for that matter at the NVC still.

I was hoping they´d be able to fix things fast for us that did have a NOA1 after March 6th but not NOA2 yet.

Recieved an update on my application after my fiance sent Packet 3.

The Mumbai Consulate stated in an email that the application is:

"Your file has been forwarded to DHS for review"

What does the above mean? Is it part of a normal process?
This is scaring me so much.

I have filed the K-1 and K-2 petition for my fiancée and her daughter. Our question is can when the visa is approved the K-1 has 6 months to enter into USA. Does the daughter get to come at the same time?

Firstly, many thanks for doing this database, it is great
May I suggest another field to the database though - you could have NOA 1 date of receipt (which according to Aussiewench is the important one re this new law) and NOA1 date of report (which I think is the NOA1 date that most people have been reporting so far).
My NOA1 date of receipt is 27 Feb 2006 and date of report is 8th March. No notice to say application is being sent back ... yet!... keeping our fingers crossed.

Well if Vermont is on March 6th my date is on March 10th....but one little problem my fiance nor I have been notified yet about the cancellation and our interview is on the 23rd of june....i mean it is possible and the mail syatem in JA is not that great but makes me wonder if somehow we slipped by....hhmmm

Have you been able to check to see if March 10 is the received date on your NOA1 or the notice date. This may confirm then perhaps why your interview hasnt been cancelled and the petition hasnt been returned.

It does make sense, since their processing date says now they´re checking on cases dated from March 6th.

I think the main question now is if they are really reviewing those cases or if they are still waiting for new instructions, which would be my guess.

If your Congressman could find that out it would be the best!

There, I cleaned that up a little for you. I went by what you had in your timeline. I know your petition gets forwarded to CSC but I wanted to distiguish between the TSC and the CSC so I keep them separated.
If anyone wants me to add them please just give your info. I keep a backup from the last update and I get screwed up if I don't use that.

Fingers crossed for you, but yeah you do fall into the timeline of those that are being recalled.

Guys. I´m on hold to the Department of State.
They also give information about Visas. It´s a different number than the USCIS one.

I won´t ask them about my specific case.
I´ll just try and find out if Vermont has been processing I129Fs recalled petitions or waiting.
