Exactly, as far as I know, if in your petition it was made clear that you didn't meet through a IMB, you should have the usual security checks done and have a decision being given on your case. If, however, all you supplied was "we met on the internet" most likely the service centers will do further checking and inquiring to make sure it wasn't through an IMB.
In any case with this mess having been made with the IMBRA law all cases are delayed and with the thousands having been recalled, who knows when they'll be able to process everyone.

I don't think that doing a background check on the USC is a bad idea at all- they do checks on the foreign fiance so why not us as well? Unfortunately it just came along at a bad time for some people here on VJ who are probably going to have to wait a little longer to be with their fiances. They obviously have a reason for making this law and putting it into affect- many women (and maybe men as well) have come to the US for the wrong reasons or have gotten hurt or abused once they get here. Now I am not saying that ANOYONE on this forum is bringing their fiance for the wrong reason I am just making a general comment as to why this law is good in the end. I think it's a good idea to track people who are affected so that others will have some idea as to how it is going to affect them in the future. Waiting is not fun for anyone but ensuring the safety of future immigrants into America is not a bad cause for the wait, I think. I'm sorry this is happening to some people I hope things don't slow down too much.

I agree with you.
Not complaining about the new law...
It just doesnīt make any sense for me that in my case the petitioner is HER and Iīm the beneficiary - male.
We did not met online or through any IMB and provided evidences.
The new law is ok.. if they wanna do these checkings, go ahead...
But aprove and then desaprove a case without any further information????
What about people who have quit work, have a day to leave their house, bought aticket, have wedding plans, etc?
Who know how long will take for the petition to be received by them.. and only after that it will be checked again... and who know for how long! And then.. they will have to send it back.
And the worse thing: we wonīt know anything about whatīs happening because it was their mistake!

One factoid about my Country: the sins of the few punish the many.
It a law written somewhere ... the only loophole is if you're wealthy, top-dog in a corporation, or a famous politician ... then you automagically receive a "get out of jail free card" in short a license to [explicative deleted] with impunity.
Oh yes, rich is not wealthy and is questionable about impunity.

I think this is good advice. Now that I know how things work, it seems we'd all be better off getting our fiances air tickets to Mexico. Then it's simple, you drive down to Mexico, drive back into the US with the one you love. No waiting no, hassle. In a couple of years congress will make them citizens ahead of the people who did the right thing and went through this bullsh*t process.

Except for one thing - how is your foreign fiance going to get from Mexico to the US without a visa? If you don't want waiting or hassle, Mexico is NOT the place to do it - it's not exactly an easy place for US visa processing - Fiance, Student, Tourist or otherwise.

You missed the point, Mexico is the easiest place to get into the US. No visa required. Just ask the 10 million illegal immigrants already living here. They'll probably become citizens before the legal immigrants. And if you're a fair skinned red-head with blue eyes (like my fiancee) it's even easier to get in.

Honestly I think they want to stop abuse before it starts... They want to pinpoint the supposed high risk folks... Maybe it's because there are a lot of women who marry for the green card and then get their green card by making false allegations of abuse?

I talked to my lawyer today. He said he had one petition returned from an emabassy but NO RFE's for the IMBRA law. It seems that all they are doing is more checks. Hopefully things will get back on track soon. It's a real bummer that Nebraska has done NOTHING for people with NOA1's after March 6. I will be very glad when I see the first one.

I had my interview scheduled for 06/06/06 (the number of the beast.. might that be the reason?)
They called me on May 17th to give me the bad news.
I called them back on May18th and they had already sent it back to the USA.
Iīll update my Timeline now.

Well, my NOA2 did come with ridiculous speed. I seem to recall several people getting processed remarkably quickly out of Vermont at the same time; I suspect someone decided that due diligence wasn't being observed there.
I can handle the waiting when I know that I've done everything I need to do; it's wondering what to do next that frustrates me.

Well, I'm sorry to say that you can add me to the list. My fiance received a letter today that our petition has been recalled. The weird thing is that we don't fit the "profile" at all.
NOA1 March 8th = SO CLOSE!
I am a female USC my fiance is Male UK.
We did NOT meet through a marriage broker.
We have been together for almost FIVE YEARS.
I spent two of those years living with him in London.
So . . . why us?!?!?!?!?!?!?!?!
I just really don't understand.
Can I call someone - is there ANYTHING I can do? Our wedding is in 60 something days. This is so upsetting and horrible.
The worst part? I'm a German citizen as well as being a US citizen. We could have easily gotten married and lived in the UK no problem. We want to live here so I can be close to my Mom who has cancer. For this I'm being penalized? I just don't get it.
Sorry, I'll stop rambling. I guess my question is really - what can I do now to make this whole thing happen fast. We can't stop the wedding! Worst case senario we have a non legal committment ceremony and he goes back to the uk. When he gets his visa he returns and we go to city hall. That's not that bad but I just don't want to be apart any longer than we have to. HELP?!

Some update:
I'm almost certain that only cases submitted after 3/6/06 will get impacted by IMBRA even for VISA interview.
My interview was approved on 5/11/06, from what I know there is another lady having the same embassy as mine having her NOA2 on 3/6/06 that going through her K1 VISA interview approved on 5/16/06 has managed to collect the K1 VISA on 5/19/06 instead of me collecting my blank passport without my K1 VISA on the same day....

Iīm in the same situation as you.
Unfortunately, USCIS will only review the cases once they have it back. Thatīs why they recalled all petitions around the world.
I think they canīt say: "Ok, the petitioner here is a woman, so they should be fine". That would be descriminating men. At least thatīs why this new IMBRA law is gender neutral.
It sucks for me too. In my case, the USC petitioner is also the woman. And we did not met via an agency.. not even online. We provided evidences of how we met in person and they had alreday approved it.
What I think is that we wonīt have much trouble after they start processing our case. But who know how long this is gonna take to finish.
The USCIS officer told me on the phone that I should give them at least 30 days to call them back just to see if they have received the petition back! Of course Iīm calling them again next week...
I think the thing is that we need to ask now for general questions, since they really wonīt give us any specific answers about each case.
We need to ask them if during this security-check theyīll ask us to provide anything else, if our petitions are going to the end of the line, etc.
Before they receive our case back, thatīs the far we can go.
I have no more job, and soon will have to move. I had everything planned. Now, I donīt have a clue of how long this is gonna take.
I think from tomorrow, you should also call your fiancéeīs Consulate in the UK, the USCIS and the NVC in London.
Iīll be doing that and we can all share information here.
Good luck to us all! I really canīt take this anymore. Iīm not doing well.

... and here I was: sooo jealous that the Vermont Center moved so quickly, and wishing I could file there instead of Nebraska. But it looks as if most of the returned petitions came from there.

it's just sad.
I'm hoping those cases get re-approved quickly.

AAHH..as it is getting closer and closer to the interview date(already booked my plan ticket)...i get more and more worried... I called the embassy in JA to find out when his appt. was for and she told me and didn't say anything like well that might change...i asked her if it was safe to book my flight and she said yes..i am trying to make sense over everyone who is getting recalled...and really can't see a patern yet....i just wish there was some way in knowing if it is going to be recalled rather than waiting day to day praying that he doesn't get a letter or call saying it is canceled.....

Your NOA1 date of March 10 ....is that the received date or the notice date on your NOA1?

I don't know which one is correct.
On our NOA1 the Receipt Date is 3/1/06.
On our NOA1 the Notice Date is 3/7/06.
I don't know which date is the IMBRA tracks against.
The NOA2 has Receipt 3/7/06 and Notice 5/8/06.

The receipt date is used for everything else so I cant see this being any different. The date your petition is physically received and date stamped is the recieved date on the NOA1. This is the date that is used during the processing of the petition and the date one also uses to guage against the date they are currently processing when you check processing dates.

I think itīs pretty clear now why the petitions recalled come from the VSC.
Only Vermont has approved petitions dated after March 6th.
At some point, USCIS realized their mistake and started doing this new sec. check to the petitions they already had there.
But all others forwarded by them were no longer considered approved.
Thatīs the pattern, I think.
Also, as my opinion: they needed some time to adjust (or maybe they are still adjusting) to the new law, and probably because of this new law, the whole proccess is gonna take longer from now on.
The petitions that never left VSC should be approved soon, unless they are still trying to find out what to do. Or if they will proces the recalled petitions before the ones already there.
I think we will only know these answers when someone who got their petition recalled gets contacted either by USCIS, NVC or the Consulate. Maybe for a rescheduled interview, for a new NOA1 or for a RFE.
Seems like Vermont has stopped processing the I129Fīs. We should call them and ask if this is true.
Thank God tomorrow is a monday...
I need to know whatīs going on. I really do.

Why would Vermont have stopped processing I-129Fīs? They must keep processing ours and the recalled ones. The thing is Vermont approves faster than the other services so when they saw the mistake VSC had more petitions approved than the other services and now have more to fix. Iīm waiting to see if the recalled petitions are gonna get reapproved or if the ones that are still waiting for NOA2 will get theirs anytime soon.
Thatīs precisely what we need to be asking, WHEN will the processing restart, and WHO are they gonna process first? They canīt just stop and leave us waiting.

The other Service Centers are still processing, but they still have petitions dated before March 6th.
Maybe none of the Service Centers are procesing any petitions dated after the IMBRA law.
THATīS MY GUESS. It does make sense to me, after all Iīve been researching.
The reason for me canīt be because they are waiting for the recalled petitions. The petitions only started being recalled 10 days ago, and they got frozen before that.
I think they are still waiting to know what to do.
Maybe when they do they will realize that they didnīt need to recall it, I donīt know.
But if thatīs the atcual situation at USCIS, itīs the worst it could be. Because it means they donīt know what to do about the new law yet.
Iīm sorry.. this is how I react to situations like this. I can only think it looks really bad.
But THEY NEED to let us know, what is happening with ALL petitions submitted after March 6th.

My Bad! You're correct. The NOA1 has RECEIVED DATE MARCH 1, 2006 and NOTICE DATE MARCH 7, 2006.
The NOA2, the "Approval Notice" with the "Valid from" also in the "Notice Type" box has
RECEIPT DATE MARCH 7, 2006 and NOTICE DATE MAY 8, 2006.

If they know we are claiming for an explanation they will say something.
Since my interview was canceled, everything changed in my life.
I am spending the money I saved to buy my plane ticket to bring my fiancée to spend 5 days in Brazil next week.
I think spending time together will make us stronger to wait for "who knows how long".
I need to know whatīs going on. I canīt live like this. Did you guys realize that this is the first time since the beggining of this journey, that we donīt know whatīs gonna happen?
I mean, not that the money is the most important thing here, but we spent a lot at this. Is this even legal? To recall petitions and donīt say a word?

That's that part that's driving me nuts, not knowing what the next step is or what I'm supposed to do. I'm trying to be philosophical about things, especially since our visa process was going very quickly to begin with. We'd hoped to have the wedding in August or early September, and maybe that will still happen. But if this starts to look like it's going to drag out, I'll just scrap the application and apply for a UK fiancee visa. Which generally takes about ten days to process if they don't just issue it to you on the spot.

rlt, I think you're just going to have to take a deep breath and be patient. I plan on calling USCIS tomorrow to see if they can tell me anything, but I'm not optimistic about getting a straight answer. I'm afraid we're all just going to have to wait until the new processing is done.
Hang in there! We'll all get there in the end, hopefully sooner than later.

Rlt, hang in there, donīt spend the money on the ticket just yet, give it a week or two, this could be quickly fixable for you guys that were already ahead in the journey.
Weīll need to have lots of patience and hold on to our love and just be positive that weīll all get answers soon, and only then can we make different plans.

But you have no idea of how hard this hit me. I have already bought her the plane ticket and at least until she comes next week I can breath and think of something else.
I really dnīt se this getting over soon. The Consulate in Brazil sends their mail as regular mail. So I think the USCIS officer was right: "give us at least 30 days to receive it and call again".
