I'm having a hard time believing this since we haven't gotten the big notice on the online case status or emails yet.
Plus, I sent an email to CSC last week to ask when the RFEs were going to be sent and what the procedure would be for transferred petitions in terms of place in line. Their response was (word for word):
The petition is at this location and is pending processing, it was received June 1, 2006. Please inquire again in 45 days to allow processing to occur.

Right now IMBRA is affecting everyone that has filed a I-129F petition for fiance/spouse since March 6, and has done for quite some time now. You speak of waiver that is needed for multiple K filings - something to address the "serial" applicant. But, the RFE form posted on the forum from Vermont also seems to require a waiver request for anyone that has a criminal record. Is that how you view the RFE?
My understanding certainly was that the waiver did not come in to play on the criminal record, and that the purpose of the law was to simply disclose prior crimes to the beneficiary to insure that they were entering in to a fully informed relationship. Now, the RFE form almost looks like there will be denials of the application for certain crimes (which may only push some to marry overseas and seek K3), irregardless of the beneficiary's desire and wishes.
What is your take on the RFE?

I guess this explains why my K3 NOA1 date is March 23rd, and there has been no online update since April 8th.

It is asking for the exact same information that is now also requested on the new I-129F and what is entailed in the IMBRA.
K-3's appear to be just as caught up in IMBRA as K-1's.
The waiver for violent crimes could very well be to not have this disclosed to the beneficiary, especially as waivers for convictions according to the I-129F instructions and the IMBRA can only be sought under specific circumstances. To my understanding it is totally up to the beneficiary when informations is disclosed, as to whether they wish to continue with the visa application.

Got the following from my lawyer today.
Not sure if it helps at all.
Just makes me feel that the USCIS is not keeping there information up to date enough for us.
"CSC is up to March 6, 2006. We have received several adjudications from cases receipted March 5, 2006 and earlier. NSC no longer does I-129F filings so their update is worthless information. We have not yet received a RFE. Follow up with me early next week for an update. Try and have a good weekend..."

So no one that has had their case transferred from NSC to CSC has had the RFE touch yet, right? I just wanted to make sure. Do you think they'll send them all out on the same day? Where the VSC RFE's all sent out the same day?

No. Vermont is still sending it.

Quick question:
my case was updated today and I got 3 emails saying the exact same thing.
Does it mean they touched my case 3 times today or this is just a email-crazy-system thing?

Probably e-mail crazy system, people usually get e-mail updates by the bunch.

I kno how it feels.
I actually HAD my interview schedulled....
Anyways, just want to let you know they updated my status yesterday for the first time since it was approved in April.
They touched me today too and it says my case was reopened and it´s now being procesed.
I think they now how to work on people with NOA2.
I´d say it won´t take long before it happens to you too.

And I´m now expecting a RFE touch.. if they reopened my case and I fall under IMBRA, I think I should be getting it soon.

Zethris, I am also going through Vermont for a Philippines application as well, and I've received no word yet either. My NOA2 was March 30, and the petition was sent back from Manila on June 2. My USCIS online status is still "Approved on March 30." Just giving you a bit of consolation that you're not alone! I haven't heard from anyone going through Manila who have received an updated email yet...it can't be much longer though!

Well I haven't even gotten notice that it has been sent back yet. The embassy seems to think it's still there, but answer too quickly to truely be looking for it phyicaly.

Below is an update I received concerning I-129F applications. It appears that they are sending a large amount of them out today.

devilette, just checked my status online, nope... no touches nor emails. maybe they are still on ther 3 hour coffee break.... this whole thing is getting to me. i had a dream this morning and we were in line at this office getting our RFEs... there was this man in front of me and he was looking at this sheet he got. he thought it was an RFE, so i read it over and over again and it said that his application was approved. so i went ahead and explained it to him. we were both in disbelief. i looked at the white envelope that i had in my hands and had the same thing. before i could even rejoice i woke up, my dogs had to go use the bathroom. #$*()#@ hahaha... it was a good dream. at least somwhere i was getting notices...then again, i hope im psychic. hahahha

I really don't know what to make of this. I just got an email from my senator (his immigration aid really). My status hasn't changed online and my lawyer hasn't gotten anything yet. Do I dare get excited?????

Well, it's coming! They usually take 2 days to actually post it, the update when it leaves USCIS sending office, not when it actually LEAVES the post. That's why it takes longer than it's supposed to.

All depends on what time they gave them to the post office. After a certain time and they would not be processed until the next day. (that all depends on if they did give them to the post office). But you would think in State would go faster. Maybe they where prepared on the 23 but not sent until the 24th.
Hope they arrive soon.

For anyone waiting for their petition to return from Manila, I finally received this today from NVC:
Dear Sir/Madam:
The National Visa Center (NVC) has received your inquiry regarding a petition sent to the NVC from the U.S. Embassy/Consulate General. The petition was received at the NVC and is being forwarded to U.S. Citizenship and Immigration Services (CIS - formerly known as INS) for processing. All inquiries and submissions of additional documentation should be directed to the CIS office that originally approved the petition.

Now keep in mind that 2 days ago their reply was the typical "NVC sent the petition to the US Embassy in Manila on April 1" and only when I followed it up with an e-mail mentioning that it has been almost a month since Manila sent the petition back did I get THIS e-mail. So maybe they're just trying to get me off their backs for now. But it's the first sign of ANYthing for me since April 1, so I'm thrilled. When and if my online status is updated I'll post it here, because as far as I know no one going through the Philippines on an NOA2 has been given word yet on their RFE.

What I was saying about it usually takes two days is that when we got our NOA1 it said April 19th it had been sent, but on the envelope the stamp from the post office said it was mailed out on the 22nd. Same thing happened now with the RFE, meaning they don´t actually mail it out on the same day they update the status online to say it´s been sent, it´s actually sent (for real) a couple of days later.
