Did anyone try to call USCIS today yet?
I couldnīt reach an operator...
My questions would be:
1 - Have you already sent any RFEs for IMBRA?
2 - Is it gonna be by snail mail or weīll be able to download it?
3 - Are the recalled petitions receiving it first?

I am pretty sure RFEs will be sent snail mail way, and it will already include the questionaire so you wonīt do anything online, most likely.

I hated to be the pessimist in the midst of all the good news, but when they say 'immediate' RFE's, what exactly is the government's definition of 'immediate'?
If its the same as their BS 90 day timelines they're good at tossing out, I would assume 'immediate' would be about 3 weeks from now.

But since there's lots of spotlight on them now, that might nip that in the bud.

I just got off the phone with them as well. The Customer Service Rep transferred me to an Immigration Officer, who wasn't rude, but nor was he helpful. When I asked if my file had been received in Vermont yet, he just kept saying that he didn't know, and that the Embassy was part of the State Department. No ######, Sherlock.
But he did give me the name of the Vermont director, and suggest I write directly to her to find out what has become of our application. I'm drafting the letter now.

I received NOA1 on Mar 10th, Approved (NOA2) on May9th - I got a letter that it will forwarded to National Visa Center and haven't heard since. So today I got through to USCIS who said they can't tell me anything because they forwarded my application to NVC, I called NVC and they said they can't tell me anything because they received it and returned it back to USCIS because of IMBRA (I do not have anything to do with any international marriage boards, or online dating sites - but still get punted in this beaurocratic ping pong) I didn't get any notice yet - I understand RFE are supposed to be sent. Has anyone seen what the additional requirements are so I can at least get started in getting them together, or if there are better ways to respond to them? Faxing them in, calling in a lawyer?

I think you are way behind . . .
It doesn't matter if you have anything to do with international marriage boards or online dating sites - the IMBRA law affects every single person who filed for a K1 after March 6.
The first official posting from USCIS was LAST NIGHT. We JUST got word of that RFEs are forthcoming. It does not seem there is anything you can do now to getting anything together. You cannot respond to them, fax them, or have your lawyer do anything. You need to wait until they send you an RFE. That's what ALL of us here are doing!!!

I checked OMB website and the I129F is no longer listed as a PENDING REVIEW application as it still was this morning.

Everythingīs been done and approved.
We only need USCIS to send the RFEs.
I couldnīt talk to an officer today but will try again tomorrow.
As we know they all say different things, Iīd appreciate if you guys could call them and ask if they have already sent any, or when they will start doing that.

Here is my opinion on the answers you received from the service center today. They always like to give you the worst case scenario, because they don't want to be liable for giving you the wron information. Just like the timelines they list. Things always get done before the actual number of days they state. SO when you called them today, they don't want to tell you, yes you will get your RFE this week or next week, because if they told you this and for some reason you don't receive it then you got major beef with them. The other problem is they need to send out 10,000 of these, and who knows how thye are handling this issue. So they really can't say when each of us will receive ours, because I am sure they can't send them all out at once. They probably have some system set up. Maybe they will send all those with petition dates in March there RFE's the first week, and so on and so on. I don't think they want to send 10,000 out at once, and then receive 10,000 in the same week. They may stagger them. I am just very optimistic about them saying IMMEDIATELY, because they always give you the worst case scenario.
Wait until the first person gets their RFE and posts it. This will cause major stress for those who don't receive their RFE's that same day. Where is our RFE? Why did he get his and we didn't get ours? I feel just like the rest of you on this, my nerves are shot, all I think about all day at work is, when am I going to get my RFE, what are they going to request? I just can't wait for this to be all over, and our cases are on their way. We are owed an apology, and the consulates and embassies better expedite our cases back to the original postition without further delay.
Good Luck Everyone!!!

Well i'll jump in on this particular comment because it is part of what I have been working on this last week with my lawyers. They contacted the right people it seems and have been able to put a fire under the decision makers. Also, I had my friend Mitt Romney (Governer of MA) make a call and he did so along with my (our) legal representation out of New York.
Previously it was going to be 30 days before RFE's were going to be sent out because they wanted to wait until the official I-129F form was released. However, they already had the section about the background check approved. So with some leveraging, we should now see many of the RFE's begin to be sent in the mail within 7-10 business days as of this Monday. But because of the volume, there could be a slight delay.
We can thank that those who run the DHS and USCIS are still human and sometimes the too realize how stupid bureauacracy can be. So, they saw reason in the letter and communication they recieved and they updated the notice. But, even with this news, changes can still happen. Someone there could have a different opinion, or 10,000 RFE's in 7-10 days is not plausible. But, at least it seems to be a tiny bit more expidited and they will START sending them out sooner than 30 days.
As far as any class action goes, they have decided that at this time it wont really do much good. However they are going to keep an eye on the situation and will read these message boards for possible leads to the negative outcomes of this sudden policy change and for any future effects. Not for legal retribution, but for "bug fixing" so to speak in the programming code of new law.

Well, i had received my NOA1 on May 2nd, and had not been touched at all or anything since. Then, today, I checked again, and not only had I been touched (that really does sound wrong), but my status had been updated with a message that read as follows:
Current Status:
On June 15, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 30 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours.
Seems like my RFE is on the way ....although I'll be believe it when I see it. That being said, I suppose its possible (though unlikely) that they're sending an RFE unrelated to IMBRA, which would really suck. I guess I'll just have to wait and find out.
Good luck to everyone!

I know it really gives you a feeling of uncertainty. I called today after I saw a few people were told there RFE's were either being sent or are baing prepared now. So I called and the woman said that they haven't accessed my file yet for the RFE. SO I asked about these being expedited and she said she doesn't know anything about that. I told her that isn't it in their rules that if our cases were due to USCIS error our cases are then expedited,a nd she said I guess so. What kills me is the fact that the people I saw that were told their RFE's are being sent, have a later Receipt date than me. I am assuming they have no order. Believe me I am happy for those getting their RFE's and those who can file now with the new form. It just stinks that their is no order based on Receipt date.

Exactly.
Thatīs my point too.
I mean, how hard is it? The petitions were already approved, so get those and send a RFE.
I wish we could be downloading the template and sending it. I hate depending on them.
And I think we can only ask for than to expedite our application because of their error when submiting the RFE, so weīre really up to what they will do now.
If they did mail it today some people might be getting it either tomorrow or saturday, right?
Letīs wait and see. Maybe they wonīt change our (recalled petitions) status on the website and the phone officers wonīt know they have mailed the RFE.

ok, here is my spin on the situation.....could it be the reason why Vermont is sending out the RFE's(or so it seems) to the later petitioners (not the recalled ones) is because they are already sitting on theirs desks, and not in a pile in a separate room somewhere? Perhaps also this is the reason why the electronic system shows them, and doesn't show us because we have been approved already? Which does not go to show that ours are not being worked on either....just maybe its not as easy to track??? Perhaps they need to clear their desks in order to start distributing the new recalled petitions among themselves...didn't they state they were going to process those first?
