My wife and I would like to bring her minor children here from the Philippines. They are under 21, what is the process and about how long does it take. Any pointers would be appreciated.

In that case I think you can file an I-130 for them.

Correct file I-130 for each as step Children of a USC, wait for approval from USCIS then on to the NVC. All told and with ni hang ups should take you less than a year to get them here.

good thread, I need some info too please.

K-3, my wifes daughter IS listed on the I-130 and I-129f.
My wife hasnt had her interview yet or recieved p-3.

Still need to file I-130 for my step-daughter?

I began another thread on this and a member mentioned just to file the return papers for the step-daughter with the P-3.

If your wife filed a K3 and her daughter is listed on the I-129F then you can apply for a K4 for her as a follow-to-join. In that case you would just have to return a similar packet 3 to the consulate and they will set up an interview for your step-daughter.

Your daughter will need an approved I-130 in order to adjust status from K-4 after entry. So you might as well begin the process.

Why are not ALL the children listed on the I-129F

Hi all,

I have a similar question about my own situation. I have just received my K3 and my unmarried daughter (20 years old) has an appointment at the US Consulate for her K4. We were told at my appointment that her K4 will be issued and valid until June of next year when she turns 21.

Of course she was listed on the I-130 and I-129F, but my husband did not file an I-130 for her as she was over 18 when we married, so he cannot petition for her. I know she will require an I-130, but we are totally confused as to who files the petition (we don't think he can because of not being married prior to her turning 18 and I can't until my AOS is complete) and to when it's filed (we don't think we can do it now, because of the previous "who" bit), and we have read somewhere that after she's here the I-130 is filed with her AOS. (But here of course we run into the age thing...I believe she must file AOS before turning 21 and I might not be LPR to file the I-130 for her by then.

The other aspect of this is the "Following to Join" - it says that it cannot be used by someone who entered as an immediate family member, but can be used by someone on a "fiance visa". So as a K3 holder, did I enter as an immediate relative of my husband, or on the I-129F???

This is all so confusing.... I am sure there are others out ther who have had a similar situation. (I will also post these questions in the K3/4 forum)

I have a question too....we need to have all the documentacion for NVC..but, If I have 3 children, I will have to get the same documentacion for they???..I mean, 3 original married certificates, 3 original divorce decrees + 3 birth certificates (1 for each one)...or I could just get they Original Birth Certificate for each one + 1 Original of the others documents??..., because my husband will file for my 3 children at same time....

This is confusing.... wacko.gif

If they they are separate I-130s then you will need individual documents of everything for each submission.

Yes one package of all documnets for each. When my step kids went to the interview, I had only sent one copy of 2005 and 2006 taxes. Husband had to go and make a copy as the CO wanted one copy for each file. Better to make all the packages as individual so as not to have any problems in the end.

Thanks for your help, I am going to have a lot of work to do with all this documentacion for my 3 children...but i will with a smile on my face because that means they will be with my and my husband soon...
