Hello Everyone,

My fiance had to file a waiver because of a previous overstay. We are still waiting on an answer regarding his waiver, but his physical that he got for the k-1 will expire on June 22.

My question is, can he wait until we hear an answer on whether the waiver was approved before he gets another physical?

Will he be allowed to get another physical once the first one expired?

Thank you in advance for any help that can be offered.

Yes. You are supposed to wait until the waiver comes back approved. Once it has you will need to redo both the police certificate and the physical exam. . .depending on the consulate they may also require a new DS-230 and visa fee.

Thank you for your reply. We were trying to avoid having to re-file or pay another fee (since they have gone up so much). Oh well, you do what you have to do, I suppose. What an expensive and exhausting process!!!!

You won't have to refile the 129-F once the waiver is approved. You will only have to regather the documents that have an expiration date (police cert/medical.)

ditto, my so's medical expired in April and per the consulate in Turkey when he comes to pick up his visa, then he will need to submit his new physical, no need to have it until then since it could take years for the visa to be ready
