When an LPR is petitioning her unmarried, over 21 child and the USCIS has approved it, do they have to wait more time for an interview appointment with the embassy? Or the total amount of waiting time was already done at the USCIS, meaning they approved the petition because they were the next in line to get a visa?

I'm more familiar with the immediate family member process but this is a new situation in our family, so I just wanted to be more informed.

In family preferance category. "priority date" has to be current (see Visa Bulletin) for an interview. I-130 may be approved just before that happens, or much earlier...

NVC is informed about approved I-130, and then case waits there for the next steps until PD becomes current.

Hi Diana,

Pretty sure USCIS approves the I-130 and then it will go and gather Dust at the NVC until a visa number becomes available. They are working on Visa's for the year of 1999 Sept 15 for Unmarried children over 21 of an LPR it is a F2B staus visa. Better if the person Naturlizes and moves the petition up 3 years

I know as my husband applied for his son over 18 last year and we are waiting for the USCIS however we know that a visa number will not be available for 5-6 years.

We have a similar situation and the approval date was a few months after we submitted the application; but the case was sent to NVC to wait many years until the priority date becomes current. Also, approval by the USCIS doesn't mean a guarantee visa. The embassy or NVC can find things that will not grant the visa.

I know that an approval by the USCIS does not guarantee the visas since they only go over the intial paperwork and make sure it's in order, only a CO at the embassy has the authority to do so. I was just wondering about the lenght of time at the NVC since the petition was at the USCIS for almost 9 years already.

NArocks, yes becoming a US citizen would be a lot faster but my aunt is already 80+ years old and for someone at that age to learn English is almost impossible. Also, she has about another 4 years or so until she becomes eligible to take the US citizen test without having to take the English portion of it. So it's not an option at this point.

Diana I wish you , your Aunt and you Nephew the best and quickest possible solution. And yes we all know an approval from USCIS does not guarantee anything other than an approval at that level. Especially Diana knows this smile.gif
