Full Version: Applied for K-3...I-130 & I-129F approved 1 week apart

I swear...thought I had this down - now I am TOTALLY confused again! wacko.gif

So, our I-130 was approved on 05/16/08 and entered in the system at NVC on 05/16/08. As we always do, we asked for all of your help: we chose James' Shortcuts; paid AOS Fee Bill last Saturday and sent the email vs the paper version of the DS3032. I was only waiting to send the I-864 packet.

I called today, and find out that our I-129F NOA1 was sent on 04/07/08 (never received..still!!); and that it was approved on 05/30/08.

I asked for an Agent, and the man I spoke to basically stated the following:

1.) Gave me the receipt number for the I129F (no idea it was different from I-130)
2.) Told me they are two different requests: the I-130 is for the K3 (which is what we applied for way back in October 2007; and the I-129F is the CR-1. The basic difference is what my husband's status will be when he gets to the U.S. - either a non-immigrant or an immigrant. It will also affect how quick he comes - told it is a difference of only a few weeks to a month.
3.) The agent then said I needed to determine which one to go with.....the I-130 was approved first and I have completed a portion of the next steps; but, have NO idea what I should do with the I-129F...if ANYTHING!!

I hope someone has some advice on this....because I know we are close....but just not sure to WHAT?? LOL

We had a similar situation (I-130 approved, I-129f approved later) and we did the whole NVC thing for a CR-1 visa in 31 days. Our interview is in early July and when my husband gets his visa heŽll have his SS#, be able to work immediately, and it cost us less in the long run because AOS in the US is expensive! So overall, we were content with the change of plans. I guess it depends on if youŽre more concerned with now or then. Although, I really donŽt think it took too much longer than it would have with the K-3 visa.

Hey Kim!!

See an the USCIS agent told me the opposite. I was thinking from us talking before, that this was the case. However, he is saying different.

I really just want to continue with the process on the I-130...since it was first. He says it is the K-3, and he will have to apply for everything here.

I hate this!
