Full Version: after getting K-3 visa, next steps!!

hey to all .

I ve got the K-3 visa 2 weeks ago, came to the USA. Though before the K-3 interview we had I-130 NOA-2 approved.
Now we have 1 year of our marriage. WHat do i need to do next:
1. to call NVC and find about the I-130?
2.File for AOS now?
3.Or wait like half a year so the marrige will have 1.5 year and there is a chance to get the Permanent Green card after the USCIV will get from me the AOS forms?

If you are in no hurry to work, yes, I'd wait maybe eight or nine months to file the AOS but not more than a year after the day you had the medical exam. As long as your two-year wedding anniversary precedes the AOS approval, you'll get the unconditional permanent residency and ten year card.

THANKS PUSHBRK for your hellp, you always give some useful advice, i apreciate it. I really was wondering about the better manner of acting. Some days ago i filed for EAD to get the working permission cause it really kills me not to have the right to work.... Hopefully i ll get it soon.
And by the way DOES ANYBODY KNOWS THE USUAL PROCESSING TIME OF AOS?

You can check the timelines but with no complications, it can be from 3 to 6 months. You can reschedule the interview if it comes too soon.

Hi. I'm interested in this too. I will be posting soon with our story and some questions, but for now, since it came up, I wonder about the time frame for filing AOS once a K3 is issued.

I'm totally new to all this, but from reading up on stuff, I understand that the K3 is for two years with possibility for extension only if the AOS has been filed before two years are up. Where did you get the one-year cut-off? Is there any indication that filing 16 months (for example) after the k3 is issued will be seen/treated differently than filing, say, 11 months later?

Just curious as to how one can know - have there been problems in the past when people waited longer than 12 mo. to file?

It's not a cut-off but if your medical is more than a year old when you file AOS, you'll need a new medical. It costs $300 where I live.

K3s can't get SSN without an EAD or green card. Can be a b!tch living in the US without one as they are required to get a lot of things such as a drivers license.

Ah, thanks mucho, pushbrk.

So, at the very least, delayed AOS filing adds costs for the medical and the EAD (if desired). That could really add up with our 3 kids !
