Fiance's interview was tomorrow at 9am. Just got call today that his interview has been cancelled by USCIS because they need to re-review the petition and if approved once again then they would reschedule the appointment. Anyone have this happen to them? Does the whole process start all over again? How long would it take? So upset right now cuz the interview was tomorrow!!! all the excitement down the drain. They said it was because of some immigration marriage law or something. I called USCIS and they dont have any status on my petition except that it has been approved (1st approval). Would the petition go back to USCIS and then resent to NVC and then back to london? Any input would be greatly appreciated. Thank you. =(

What????? Maybe you can give us more info......your timeline is not updated so not sure what is happening with you case. Was your interview scheduled at the embassy in London???? When did you receive packet 3 and drop of the DS230???? Were you and your fiance ever married before???? What marriage law are they talking about????

I think you should call the consulate again and ask for more details about the reasons they had to do this and how long this "review" will take!

I dont have the exact dates with me but my fiance sent his packet 3 the same day he received it because he had everything ready. I believe it came right after easter. Then they sent him packet 4 on May 4th but he received it late so he called the embassy to check the status and they told him his interview is on may 11th. Then today he got a call from the embassy telling him that they have been contacted by USCIS and his appointment has been canceled because they need to go over our petition again and approve it again. I dont know why?? i have never read any cases like this before and I dont want our case to be "lost in the system" and for us to wait forever for it to finally be approved. I dont know what to do and no one can provide more information. My fiance called the embassy and they said its right that it has been canceled and that he should contact USCIS if he has any questions. I called them and they said "things like this can occur" but they cant give me any information on this cuz they dont even have it in their system! What to do?? He had his medical done right after packet 3 was sent back so he was just waiting for his interview date. We are both so lost now. =(

So, I guess you'd have to contact your Congresman for him to check what's really going on! That's not a normal thing and, since you don't have anything diferent from the others to investigate, your process should be done like anyone else's is!

we have had a normal case up until this. no criminal background. nothing bad to hurt our case.

I can only guess that maybe your file was reviewed for Quality Assurance puposes and the original processor missed something. Maybe some critical information required to approve the K-1 was missing such as primary relationship evidence, birth certifcates, passport photos, intent to marry statements or something.....Or...something on the security clearance was overlooked and now finally cught during the QC audit process.

Sooooo sorry to hear but I would call USCIS again and demand more information from them as to WHY this sort of thing can happen. I would also call an immigration attorney and ask them for their advice.

I am planning to fly out for my fiances appointment at the embassy so if they start doing this regularly......I will have a stroke....Can't imagine being in the country and having made the trip for nothing!!!!

i called USCIS...got transferred 3 times...talked to an immigration officer and he couldnt give me any more info than the other two. they said they dont have anything in their system but according to the embassy...USCIS is the one that made the call to cancel the appointment. all the guy could tell me is "things like this can occur wait a few weeks and then check" he said he doenst know how long it would take maybe 1 month maybe 6 he doesnt know. he said they would contact me should the status of it would change..and that was that. How can I find out more? anything i can do to speed this up or to find the source of the problem? any #'s or any people i can contact? I cant seem to get a direct answer as to why this happened. demanding doesnt help either cuz they dont have any info at all.

I have never seen this in my 18 months on this board.

it has to do with the international marriage brokers law. it does not even relate to us. i have no idea why ours is being reviewed for it. do they just do a lottery or something for this? and we were the unlucky ones? man i hope this doesnt take long

The only thing I can think of is to try e-mailing the consulate for a better answer. It might take you a day or three to get a decent answer out of them, but I bet you will find out something. Use your case number in the subject line of the mail.

I emailed the embassy right away after i found out about this. What i dont understand is why is it us? his interview is tomorrow and we have a normal case. never went thru an online or a mail order dating bride whatever that thing is. We met in person first and after that talked online and then met twice after that. dont know whats going on and i dont like it at all since we have made so many plans. i just hope it all works out FAST. are they going to do this with everyone's file now?

For the benefit of the diehard 'you don't need a lawyer for a simple case' crowd - not any more you don't.

Getting back on topic, this is strange indeed and I hope that whatever the problem is it's not something serious. Hopefully it will turn out to be a SNAFU, not a FUBAR, and will be cleared up quickly.

We'll all be waiting to learn what caused the problem and how it's resolved.

Our petition just got cancelled under identical circumstances. The reason I was given is the introduction of IMBRA. See my thread for details.

Im not sure if they used the term canceled. My fiance's interview was tomorrow morning and they canceled his interview stating that USCIS requested this due to the IMBRA law. They said they would review it again and if approved, the appointment would be rescheduled. I really dont know how long its going to take but if they are going to do this with all the petitions approved after march 6th then there are going to be ALOT of unhappy people. I have not yet found a way to get around this issue.

Cancelled was probably a misnomer but that was the language they used when I called. Since the indication was that the case would go back to the original service center for further adjudication I assume this means things would then proceed subsequently if everything was in order.

Hopefully they'll put a rush on the affected cases.

yea i know they said that USCIS would have to review it again. Seriously it seems like its gonna take a month before we hear anything if its gonna be going back to USCIS. hopefully these cases are prioritized before all the other cases. I just cant believe they waited this long to do this when they had the chance while my petition was with them. Hopefully something good comes out of it.

Oh my god! This is terrible and downright wrong.. of course it's the law targeting the WRONG people... I thought the law would be kinda geared towards the countries that have lots of marriage brokers and female trafficking problem (Not picking on any certain country but E. European and Southeast Asian countries) ???

I thought this was only in effect if the USC is male. Unless I am mistaken the 2 people in this topic that had this happen to the USC was female.

Hey guys, so i am very sorry to hear about this experience you ar ehaving. i went online to try and find out as much as i could and this site is great for answers http://usaimmigrationattorney.com/nucleus/index.php?itemid=2 . did you say that you met through friends? cuz it did say something about checking some people who met through friends or family not just people who met through IMB. that could be why that is. it also said that most people who applied before march 6, 2006 will not be checked but some will. it looks like people applying in the future will have to deal with this more than people who applied before that date. its just unfortunate that it happened to you. for some reason they think that the reason you met is a little suspicious i guess. it says also that this is not only limited to USC males. please read this site is has some really good information and i hope that this helped a little. i hope everything gets better for you!!!!

this law doesnt seem to apply to me at all. this is the first time i have ever filed a petition. we dont have a criminal background. we didnt go thru any agency or anyone else for that matter. we have known eachother since we were little. i read everything on that website and none of it applies to us. i just dont know why they selected us. maybe there wasnt sufficient enough evidence to show that we didnt go thru an agency or meet thru friends?

You are missing your Criminal Affidavit. Did you file one with you original Petition??

what criminal affidavit. I followed all their requirements. All i needed to submit at the time was my I-129F with the evidence. It never said anything about a criminal affidavit. Plus my petition was filed before this law so it shouldnt even affect me! but still they cancelled our interview =(

criminal affidavit I think means 'police report' - but for UK you dont send that - you TAKE it with you to the Emabssy at interview.

yea my fiance has his police cert. I was never required to get one so I never sent one in.

IMBR has created a 'gray' area that will affect those currently in the process.
